Hadith #19

حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مَنْصُورٍ قَالَ سَمِعْتُ مُجَاهِدًا يُحَدِّثُ عَنْ أُسَيْدِ بْنِ ظُهَيْرٍ قَالَ كَانَ أَحَدُنَا إِذَا اسْتَغْنَى عَنْ أَرْضِهِ أَوْ افْتَقَرَ إِلَيْهَا أَعْطَاهَا بِالنِّصْفِ وَالثُّلُثِ وَالرُّبُعِ وَيَشْتَرِطُ ثَلَاثَ جَدَاوِلَ وَالْقُصَارَةَ وَمَا سَقَى الرَّبِيعُ وَكُنَّا نَعْمَلُ فِيهَا عَمَلًا شَدِيدًا وَنُصِيبُ مِنْ
هَا مَنْفَعَةً فَأَتَانَا رَافِعُ بْنُ خَدِيجٍ فَقَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَكُمْ نَافِعًا وَطَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْرٌ لَكُمْ نَهَاكُمْ عَنْ الْحَقْلِ وَقَالَ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَمْنَحْهَا أَخَاهُ أَوْ لِيَدَعْهَا وَنَهَانَا عَنْ الْمُزَابَنَةِ وَالْمُزَابَنَةُ الرَّجُلُ يَكُونُ لَهُ الْمَالُ الْعَظِيمُ مِنْ النَّخْلِ فَيَجِيءُ الرَّجُلُ فَيَأْخُذُهَا بِكَذَا وَكَذَا وَسْقًا مِنْ تَمْرٍ

English Translation
Muḥammad ibn Jaʿfar narrated to us, he said: Shuʿbah narrated to us, from Manṣūr, who said: I heard Mujāhid narrating from Usayd ibn Ẓuhayr, who said: When one of us had no need for his land or was in need of it, he would give it for a half, a third, and a quarter. A man would sow what was along the streams and waterways and what the water had settled on. The Messenger of Allāh ﷺ came to us and said: 'Whoever has land, let him cultivate it or let his brother cultivate it, and let him not rent it for a third or a quarter or a specified portion of food.'
