Arabic Text

وَرَوَى أَبُو دَاوُدَ, وَابْنُ مَاجَهْ: مِنْ رِوَايَةِ عُمَرَ بْنِ خَلْدَةَ قَالَ: أَتَيْنَا أَبَا هُرَيْرَةَ فِي صَاحِبٍ لَنَا قَدْ أَفْلَسَ, فَقَالَ: لَأَقْضِيَنَّ فِيكُمْ بِقَضَاءِ رَسُولِ اَللَّهِ ‏- صلى الله عليه وسلم ‏-{ مَنْ أَفْلَسَ أَوْ مَاتَ فَوَجَدَ رَجُلٌ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ } وَصَحَّحَهُ اَلْحَاكِمُ, وَضَعَّفَ أَبُو دَاوُدَ هَذِهِ اَلزِّيَادَةَ فِي ذِكْرِ اَلْمَوْتِ 1‏ .‏‏1 ‏- رواه أبو داود ( 3523 )‏، وابن ماجه ( 2360 )‏، والحاكم ( 2 / 50 )‏ وسنده ضعيف؛ إذ فيه أحد المجاهيل، إلا أنه أحد شواهد الرواية السابقة.‏

English Translation

Abu Dawud and Ibn Majah reported the aforesaid Hadith from the narration of 'Umar bin Khalda which has: "We went to Abu Hurairah (RA) regarding a friend of ours who was bankrupt. He said, "I shall certainly pronounce judgment about him in accordance with the judgement of Allah's Messenger ﷺ. Whoever becomes bankrupt or dies, and a person finds his actual goods (remaining with that man), he has most right to them.'" .
