Hadith #1656
Arabic Text
أَخْبَرَنَا عُثْمَانُ بْنُ عُمَرَ ، حَدَّثَنَا يُونُسُ ، عَنْ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، وَأَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ : أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ اقْتَتَلَتَا، فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ، فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا، فَاخْتَصَمُوا فِي الدِّيَةِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَضَى : أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ : عَب
ْدٌ أَوْ وَلِيدَةٌ، وَقَضَى بِدِيَتِهَا عَلَى عَاقِلَتِهَا، وَوَرِثَتْهَا وَرَثَتُهَا وَلَدُهَا وَمَنْ مَعَهَا، فَقَالَ حَمَلُ بْنُ النَّابِغَةِ الْهُذَلِيُّ : كَيْفَ أَغْرَمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ، وَلَا نَطَقَ وَلَا اسْتَهَلّ، فَمِثْلُ ذَلِكَ يُطَلُّ؟، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" إِنَّمَا هُوَ مِنْ إِخْوَانِ الْكُهَّانِ ". مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ

English Translation
It was narrated from Abu Hurairah (may Allah be pleased with him) that two women from the Hudhayl tribe fought and one threw a stone at the other, killing her and her unborn child. They disputed about the blood money before the Messenger of Allah ﷺ. He ruled that the blood money for her fetus was a ghurrah: a male or female slave. He ruled that her blood money be paid by her aqilah, and that her estate be inherited by her children and those with her. Hamal ibn al-Nabighah al-Hudhali said: 'How can I pay blood money for one who neither drank nor ate, who neither spoke nor cried out — such a one is voided (tutla)?' The Messenger of Allah ﷺ said: 'This man is one of the brothers of the soothsayers' — because of his rhymed speech.
