Arabic Text
حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنْ عَامِرٍ : أَنَّ الْمُعْزِلَةَ بِنْتَ الْحَارِثِ تُوُفِّيَتْ بِالْيَمَنِ وَهِيَ ي
َهُودِيَّةٌ، فَرَكِبَ الْأَشْعَثُ بْنُ قَيْسٍ، وَكَانَتْ عَمَّتَهُ، إِلَى عُمَرَ فِي مِيرَاثِهَا، فَقَالَ عُمَرُ : " لَيْسَ ذَاكَ لَكَ،يَرِثُهَا أَقْرَبُ النَّاسِ مِنْهَا مِنْ أَهْلِ دِينِهَا، لَا يَتَوَارَثُ مِلَّتَانِ "
Isnad Chain
English Translation
It was narrated from 'Amir (al-Sha'bi) that al-Mu'zila bint al-Harith died in Yemen while she was a Jewess. Al-Ash'ath ibn Qays rode to Umar to inquire about her inheritance — she was his paternal aunt. Umar (may Allah be pleased with him) said: 'That does not belong to you — she is inherited by the person closest to her from among the people of her religion.'
