أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، حَدَّثَنَا الْ

أَشْعَثُ ، عَنْ الشَّعْبِيِّ ، قَالَ : كَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَى شُرَيْحٍ : أَنْ" لَا يُوَرِّثَ الْحَمِيلَ إِلَّا بِبَيِّنَةٍ، وَإِنْ جَاءَتْ بِهِ فِي خِرَقِهَا "

English Translation

It was narrated from al-Sha'bi that Umar ibn al-Khattab (may Allah be pleased with him) wrote to Shurayh: 'Do not give a foundling (hamil) an inheritance share except with evidence — even if his mother brings him wrapped in her clothing.'
