حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ ، حَدَّثَنِي اللَّيْثُ ، حَدَّثَنِي يُونُسُ

عَنْ ابْنِ شِهَابٍ : وَسَأَلْنَاهُ عَنْ السِّقْطِ، فَقَالَ :" لَا يُصَلَّى عَلَيْهِ، وَلَا يُصَلَّى عَلَى مَوْلُودٍ حَتَّى يَسْتَهِلَّ صَارِخًا "

English Translation

It was narrated from Abu Qilaba that he said: 'Umar ibn al-Khattab (may Allah be pleased with him) was asked about a woman who died in childbirth — she and the child died together. He said: the child inherits from the mother if it cried out, and the mother's heirs inherit from the child.
