حَدَّثَنَا يَزِيدُ أَخْبَرَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ الْمَخْزُومِيِّ عَنِ ابْنِ عُمَرَ أَنَّ رَجُلًا اشْتَرَى نَخْلًا قَدْ أَبَّرَهَا صَاحِبُهَا فَخَاصَمَهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الثَّمَرَةَ لِصَاحِبِهَا الَّذِي أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي
English Translation
It was narrated from Ibn 'Umar (رضي الله عنهما) — via Yazid, from Hammad ibn Salama, from 'Ikrima ibn Khalid al-Makhzumi — that a man bought palm trees that their owner had already pollinated [abbara]. He brought his dispute to the Prophet ﷺ, and the Messenger of Allah ﷺ ruled that the fruit belongs to the one who pollinated them — unless the buyer stipulates [otherwise].
