حَدَّثَنَا إِسْحَاقُ أَخْبَرَنِي مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَن

َّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ أَعْتَقَ شِرْكًا فِي عَبْدٍ فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ فَإِنَّهُ يُقَوَّمُ عَلَيْهِ قِيمَةَ عَدْلٍ فَيُعْطَى شُرَكَاؤُهُ حِصَصَهُمْ وَعَتَقَ الْعَبْدُ عَلَيْهِ وَإِلَّا فَقَدْ عَتَقَ مَا عَتَقَ

English Translation

It was narrated from Ibn 'Umar (رضي الله عنهما) — via Ishaq, from Malik, from Nafi' — that the Messenger of Allah ﷺ said: 'Whoever frees his share of a jointly-owned slave — if he has wealth sufficient to cover [the rest of] the slave's value, [the slave] is to be assessed at a fair price and his partners are given their shares, and the slave is freed from him [in full]. Otherwise, he has freed only the portion he freed.'
