حَدَّثَنَا يَعْلَى حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ يَسْأَلُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ يَا رَسُولَ اللَّهِ جِئْتُ أَسْأَلُكَ عَنْ الضَّالَّةِ مِنْ الْإِبِلِ قَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا تَأْكُلُ الشَّجَرَ وَتَرِدُ الْمَاءَ فَدَعْهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ الضَّالَّةُ مِنْ الْغَنَمِ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ تَجْمَعُهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ الْحَرِيسَةُ الَّتِي تُوجَدُ فِي مَرَاتِعِهَا قَالَ فِيهَا ثَمَنُهَا مَرَّتَيْنِ وَضَرْبُ نَكَالٍ وَمَا أُخِذَ مِنْ عَطَنِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللَّهِ فَالثِّمَا
رُ وَمَا أُخِذَ مِنْهَا فِي أَكْمَامِهَا قَالَ مَنْ أَخَذَ بِفَمِهِ وَلَمْ يَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَمَنْ احْتَمَلَ فَعَلَيْهِ ثَمَنُهُ مَرَّتَيْنِ وَضَرْبًا وَنَكَالًا وَمَا أَخَذَ مِنْ أَجْرَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللَّهِ وَاللُّقَطَةُ نَجِدُهَا فِي سَبِيلِ الْعَامِرَةِ قَالَ عَرِّفْهَا حَوْلًا فَإِنْ وُجِدَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ وَإِلَّا فَهِيَ لَكَ قَالَ مَا يُوجَدُ فِي الْخَرِبِ الْعَادِيِّ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ

English Translation
It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Ya'la, from Muhammad ibn Ishaq, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that he said: 'I heard a man from Muzayna asking the Messenger of Allah ﷺ: "O Messenger of Allah, I came to ask you about a stray camel." He said: "It has its own footwear [hooves] and water vessel [stomach] — it eats from trees and drinks from water. Leave it until its owner finds it." He asked: "A stray sheep?" He said: "It is for you, or your brother, or the wolf — gather them until their owner comes." He asked: "A harisa [animal stolen from its pasture]?" He said: "In that case, [the thief pays] its price twice and receives a disciplinary flogging [nakala]. But what is taken from its [enclosed] pen — in that, the hand is cut when what is taken reaches the value of a shield [al-mijan]." He asked: "O Messenger of Allah, and fruits — things taken from them while still enclosed?" He said: "Whoever eats with his mouth without filling his garment — nothing is upon him. But whoever carries [fruit] away — he owes its price twice, flogging, and disciplinary punishment. And what is taken from the threshing floor — in that, the hand is cut when what is taken reaches the value of a shield." He asked: "O Messenger of Allah, and found property [luqata] found on a populated road?" He said: "Announce it for a year. If its owner comes, hand it over; otherwise it is yours." He asked: "What is found in an ancient ruined site?" He said: "In that — and in buried treasure [rikaz] — one-fifth [khums is due]."'
