Hadith #227

حَدَّثَنَا مُحَمَّدُ بْنُ مُصْعَبٍ حَدَّثَنَا الْأَوْزَاعِيُّ عَن الزُّهْرِيِّ عَن حَرَامِ بْنِ مُحَيِّصَةَ عَن الْبَرَاءِ بْنِ عَازِبٍ أَنَّهُ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا وَأَنَّ مَا أَصَابَتْ الْمَاشِيَةُ بِاللَّيْلِ فَهُوَ عَلَى أَهْلِهَا
English Translation
Muḥammad ibn Muṣʿab narrated to us: al-Awzāʿī narrated to us, from al-Zuhrī, from Ḥarām ibn Muḥayyiṣah, from al-Barāʾ ibn ʿĀzib, that he had a she-camel that was in the habit of straying, and it entered an orchard and caused damage. the Messenger of Allah ﷺ ruled that guarding orchards is the responsibility of their owners during the day, and guarding livestock is the responsibility of their owners at night, and that whatever damage livestock causes at night is the liability of their owners.
