حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ حَدَّثَنَا الْحَارِثُ بْنُ سُلَيْمَانَ حَدَّثَنَا كُرْدُوسٌ عَنِ الْأَشْعَثِ بْنِ قَيْسٍ أَنَّ رَجُلًا مِنْ كِنْدَةَ وَرَجُلًا مِنْ حَضْرَمَوْتَ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي أَرْضٍ بِالْيَمَنِ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللَّهِ أَرْضِي اغْتَصَبَهَا هَذَا وَأَبُوهُ فَقَالَ الْكِنْدِيُّ يَا رَسُولَ اللَّهِ أَرْضِي وَرِثْتُهَا مِنْ أَبِي فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ ا
للَّهِ اسْتَحْلِفْهُ أَنَّهُ مَا يَعْلَمُ أَنَّهَا أَرْضِي وَأَرْضُ وَالِدِي وَالَّذِي اغْتَصَبَهَا أَبُوهُ فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّهُ لَا يَقْتَطِعُ عَبْدٌ أَوْ رَجُلٌ بِيَمِينِهِ مَالًا إِلَّا لَقِيَ اللَّهَ يَوْمَ يَلْقَاهُ وَهُوَ أَجْذَمُ فَقَالَ الْكِنْدِيُّ هِيَ أَرْضُهُ وَأَرْضُ وَالِدِهِ

English Translation
It was narrated from al-Ash'ath ibn Qays (may Allah be pleased with him) that a man from Kinda and a man from Hadramawt disputed before the Messenger of Allah ﷺ. The man from Hadramawt said: 'O Messenger of Allah, ask him — for he has land that his father seized from me.' The Kindi said: 'It is my land in my possession — I have no obligation toward him.' The Prophet ﷺ said to the Hadrami: 'Bring your proof.' He said: 'I have no proof.' He said: 'Then his oath suffices against you.' He said: 'O Messenger of Allah, he is a man with no religion — he will not hesitate to swear.' The Prophet ﷺ said: 'You have no recourse against him except his oath.' So he went to swear, and the Messenger of Allah ﷺ said: 'As for the man who takes this oath to seize property that is not his, he will meet Allah while Allah is turning away from him.'
