حَدَّثَنَا يَعْلَى ، حَدَّثَنَا إِسْمَاعِيل ، عَنْ عَامِرٍ ، عَنْ مَسْرُوقٍ : فِي رَ
Body (Matn)
جُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ، قَالَ :" مَالُهُ حَيْثُ أَوْصَى بِهِ، فَإِنْ لَمْ يَكُنْ أَوْصَى، فَهُوَ فِي بَيْتِ الْمَالِ "
English Translation
It was narrated from al-Sha'bi that he said: 'Ali (may Allah be pleased with him) ruled differently from 'Umar (may Allah be pleased with him) regarding the sa'iba — 'Ali said: his inheritance goes to those who freed him; 'Umar said: to the public treasury.
