Hadith #2435
Arabic Text
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ ، حَدَّثَنَا حَيْوَةُ ، أَخْبَرَنِي سَهْمُ بْنُ يَزِيدَ الْحَمْرَاوِيُّ : " أَنَّ رَجُلًا تُوُفِّيَ وَلَيْسَ لَهُ وَارِثٌ، فَكُتِبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَهُوَ خَلِيفَةٌ، فَكَتَبَ : أَنْاقْتَسِمُوا مِيرَاثَهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ، فَقُسِمَ مِيرَاثُهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ فِي عِرَافَتِهِ "
English Translation
It was narrated from Sahm ibn Yazid al-Hamrawi that a man died without any heir, and a letter was written about him to 'Umar ibn 'Abd al-'Aziz (may Allah be pleased with him) while he was caliph. He wrote back: "Divide his inheritance among those who were registered to receive the stipend (ata') alongside him." So his inheritance was divided among those who had been registered with him in his clan's register.
