Hadith #2438Ungraded

أَخْبَرَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنْ الْقَاسِمِ بْنِ عُمَرَ ، قَالَ : " قَالَ لِي ثُمَامَةُ بْنُ حَزْنٍ : مَا فَعَلَ أَبُوكَ؟ قُلْتُ : مَاتَ، قَالَ : فَهَلْ أَوْصَى؟ فَإِنَّهُ كَانَ يُقَالُ :إِذَا أَوْصَى الرَّجُلُ، كَانَتْ وَصِيَّتُهُ تَمَامًا لِمَا ضَيَّعَ مِنْ زَكَاتِهِ ". قَالَ أَبُو مُحَمَّد ، وقال غَيْرُهُ : الْقَاسِمُ بْنُ عَمْرٍو

It was narrated from al-Qasim ibn 'Umar that Thumama ibn Hazn said to him: "What happened to your father?" He said: "He died." Thumama asked: "Did he leave a will?" He then said: "It used to be said: when a man leaves a will, his bequest makes up for the zakat he had neglected."

أَخْبَرَنَا سَهْلُ بْنُ حَمَّادٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ أَبِي يُونُسَ ، عَنْ قَزَعَةَ ، قَالَ : قِيلَ لِهَرِمِ بْنِ حَيَّانَ : أَوْصِهْ، قَالَ :" أُوصِيكُمْ بِالْآيَاتِ الْأَوَاخِرِ مِنْ سُورَةِ النَّحْلِ ، وَقَرَأَ ابْنُ حَيَّانَ : # ادْعُ إِلَى سَبِيلِ رَبِّكَ بِالْحِكْمَةِ إِلَى قَوْلِهِ : وَالَّذِينَ هُمْ مُحْسِنُونَ سورة النحل آية 125 - 128 # "

It was narrated from Qaza'a that Harim ibn Hayyan was told: "Leave a will." He said: "I counsel you with the final verses of Surah al-Nahl," and Ibn Hayyan recited from: {Invite to the way of your Lord with wisdom} to {those who do good} (Quran 16:125-128).

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ ، عَنْ مَالِكِ بْنِ مِغْوَلٍ ، عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ الْيَامِيِّ ، قَالَ : سَأَلْتُ عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى : أَوْصَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ قَالَ : لَا، قُلْت : فَكَيْفَ كُتِبَ عَلَى النَّاسِ الْوَصِيَّةُ أَوْ : أُمِرُوا بِالْوَصِيَّةِ؟ فَقَالَ :أَوْصَى بِكِتَابِ اللَّهِ. وقَالَ هُزَيْلُ بْنُ شُرَحْبِيلَ : أَبُو بَكْرٍ كَانَ يَتَأَمَّرُ عَلَى وَصِيِّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَدَّ أَبُو بَكْرٍ أَنَّهُ وَجَدَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَهْدًا، فَخَزَمَ أَنْفَهُ بِخِزَامَةٍ ذلِكَ

It was narrated from Talha ibn Musarrif al-Yami that he said: I asked 'Abdullah ibn Abi Awfa (may Allah be pleased with him): "Did the Messenger of Allah ﷺ leave a will?" He said: "No." I asked: "Then how was it prescribed for people to leave wills, or were they commanded to?" He said: "He left a will of adherence to the Book of Allah." Huzayl ibn Shurahbil added: Abu Bakr was overseeing the executor of the Messenger of Allah ﷺ — Abu Bakr would have wished to find a directive from the Messenger of Allah ﷺ that would have bridled his nose with it.

أَخْبَرَنَا يَزِيدُ ، أنبأنا هَمَّامٌ ، عَنْ قَتَادَةَ : " # كُتِبَ عَلَيْكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ بِالْمَعْرُوفِ حَقًّا عَلَى الْمُتَّقِينَ سورة البقرة آية 180 #، قَالَ :" الْخَيْرُ : الْمَالُ، كَانَ يُقَالُ : أَلْفًا فَمَا فَوْقَ ذَلِكَ "

It was narrated from Qatada regarding the verse: {It is prescribed for you, when death approaches one of you and he leaves some good (wealth), to make a bequest for parents and near relatives according to what is reasonable — a duty upon the righteous} (Quran 2:180): "'Good' means wealth. It used to be said: a thousand or more."

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا ابْنُ عَوْنٍ ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ : " أَنَّهُأَوْصَى ذِكْرُ مَا أَوْصَى بِهِ، أَوْ هَذَا ذِكْرُ مَا أَوْصَى بِهِ مُحَمَّدُ بْنُ أَبِي عَمْرَةَ بَنِيهِ وَأَهْلَ بَيْتِهِ : # فَاتَّقُوا اللَّهَ وَأَصْلِحُوا ذَاتَ بَيْنِكُمْ وَأَطِيعُوا اللَّهَ وَرَسُولَهُ إِنْ كُنْتُمْ مُؤْمِنِينَ سورة الأنفال آية 1 #، وَأَوْصَاهُمْ بِمَا أَوْصَى بِهِ إِبْرَاهِيمُ بَنِيهِ، وَيَعْقُوبُ : # يَا بَنِيَّ إِنَّ اللَّهَ اصْطَفَى لَكُمُ الدِّينَ فَلا تَمُوتُنَّ إِلا وَأَنْتُمْ مُسْلِمُونَ سورة البقرة آية 132 #، وَأَوْصَاهُمْ أَنْ لَا يَرْغَبُوا أَنْ يَكُونُوا مَوَالِيَ الْأَنْصَارِ وَإِخْوَانَهُمْ فِي الدِّينِ، وَأَنَّ الْعِفَّةَ وَالصِّدْقَ خَيْرٌ وَأَتْقَى مِنْ الزِّنَا وَالْكَذِبِ، إِنْ حَدَثَ بِهِ حَدَثٌ فِي مَرَضِي هَذَا قَبْلَ أَنْ أُغَيِّرَ وَصِيَّتِي هَذِهِ، ثُمَّ ذَكَرَ حَاجَتَهُ "

It was narrated from Ibn Sirin that Muhammad ibn Abi 'Amra made a bequest to his children and household: {Fear Allah and rectify that which is between you, and obey Allah and His Messenger, if you are believers} (Quran 8:1). He enjoined upon them what Ibrahim and Ya'qub enjoined upon their sons: {O my sons, indeed Allah has chosen for you this religion, so do not die except as Muslims} (Quran 2:132). He also enjoined them not to be ashamed of being clients of the Ansar and their brothers in faith, and that chastity and truthfulness are better and more righteous than fornication and lying — if something were to happen to him during this illness before he changed this will.

أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا أَبُو بَكْرٍ ، حَدَّثَنَا هِشَامُ بْنُ حَسَّانَ ، عَنْ ابْنِ سِيرِينَ ، عَنْ أَنَسٍ ، قَالَ : " هَكَذَا كَانُوا يُوصُونَ : هَذَا مَا أَوْصَى بِهِ فُلَانُ بْنُ فُلَانٍ، أَنَّهُيَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَحْدَهُ لَا شَرِيكَ لَهُ، وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ، وَأَنَّ السَّاعَةَ آتِيَةٌ لَا رَيْبَ فِيهَا، وَأَنَّ اللَّهَ يَبْعَثُ مَنْ فِي الْقُبُورِ، وَأَوْصَى مَنْ تَرَكَ بَعْدَهُ مِنْ أَهْلِهِ أَنْ يَتَّقُوا اللَّهَ وَيُصْلِحُوا ذَاتَ بَيْنِهِمْ، وَأَنْ يُطِيعُوا اللَّهَ وَرَسُولَهُ إِنْ كَانُوا مُؤْمِنِينَ، وَأَوْصَاهُمْ بِمَا أَوْصَى بِهِ إِبْرَاهِيمُ بَنِيهِ وَيَعْقُوبُ : # يَا بَنِيَّ إِنَّ اللَّهَ اصْطَفَى لَكُمُ الدِّينَ فَلا تَمُوتُنَّ إِلا وَأَنْتُمْ مُسْلِمُونَ سورة البقرة آية 132 #، وَأَوْصَى إِنْ حَدَثَ بِهِ حَدَثٌ مِنْ وَجَعِهِ هَذَا، أَنَّ حَاجَتَهُ كَذَا وَكَذَا "

It was narrated from Anas (may Allah be pleased with him) that he said: "This is how they used to make their wills: 'This is the bequest of so-and-so son of so-and-so — he bears witness that there is no god but Allah alone with no partner, that Muhammad is His servant and Messenger, that the Hour is coming with no doubt, and that Allah will resurrect those in the graves.' He would bequeath to those he left behind among his family to fear Allah, to rectify matters among themselves, and to obey Allah and His Messenger if they were believers. He would enjoin upon them what Ibrahim and Ya'qub enjoined upon their sons: {O my sons, indeed Allah has chosen for you this religion, so do not die except as Muslims} (Quran 2:132). He would also specify in his bequest what his needs were, should anything happen to him during his illness."

حَدَّثَنَا الْحَكَمُ بْنُ الْمُبَارَكِ ، أَخْبَرَنَا الْوَلِيدُ ، عَنْ حَفْصِ بْنِ غَيْلَانَ ، عَنْ مَكْحُولٍ حِينَ أَوْصَى، قَالَ : " نَشَهُّدُ هَذَا فَاشْهَدْ بِهِ :نَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَحْدَهُ لَا شَرِيكَ لَهُ، وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ، وَيُؤْمِنُ بِاللَّهِ، وَيَكْفُرُ بِالطَّاغُوتِ عَلَى ذَلِكَ يَحْيَا إِنْ شَاءَ اللَّهُ، وَيَمُوتُ، وَيُبْعَثُ، وَأَوْصَى فِيمَا رَزَقَهُ اللَّهُ فِيمَا تَرَكَ إِنْ حَدَثَ بِهِ حَدَثٌ وَهُوَ كَذَا وَكَذَا، إِنْ لَمْ يُغَيِّرْ شَيْئًا مِمَّا فِي هَذِهِ الْوَصِيَّةِ ". حَدَّثَنَا الْحَكَمُ ، حَدَّثَنَا الْوَلِيدُ ، قَالَ : أَخْبَرَنِي ابْنُ ثَوْبَانَ ، عَنْ أَبِيهِ ، عَنْ مَكْحُولٍ ، قَالَ : هَذِهِ وَصِيَّةُ أَبِي الدَّرْدَاءِ

It was narrated from Makhul that when he made his bequest he said: "Witness this and bear witness to it: I bear witness that there is no god but Allah alone with no partner, and that Muhammad is His servant and Messenger. I believe in Allah and disbelieve in idols (taghut) — upon that, if Allah wills, I live and die and will be raised." He then bequeathed from what Allah had provided him in what he was leaving, should anything happen to him — unless he changed anything in this will. It was also reported: this was the bequest of Abu al-Darda' (may Allah be pleased with him).

حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ ، حَدَّثَنَا أَبُو حَيَّانَ التَّيْمِيُّ ، عَنْ أَبِيهِ ، قَالَ : كَتَبَ الرَّبِيعُ بْنُ خُثَيْمٍ وَصِيَّتَهُ : بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ : " هَذَا مَا أَوْصَى بِهِ الرَّبِيعُ بْنُ خُثَيْمٍ وَأَشْهَدَ اللَّهَ عَلَيْهِ، وَكَفَى بِاللَّهِ شَهِيدًا، وَجَازِيًا لِعِبَادِهِ الصَّالِحِينَ وَمُثِيبًابِأَنِّي رَضِيتُ بِاللَّهِ رَبًّا، وَبِالْإِسْلَامِ دِينًا، وَبِمُحَمَّدٍ نَبِيًّا، وَإِنِّي آمُرُ نَفْسِي وَمَنْ أَطَاعَنِي أَنْ نَعْبُدَ اللَّهَ فِي الْعَابِدِينَ، وَنَحْمَدَهُ فِي الْحَامِدِينَ، وَأَنْ نَنْصَحَ لِجَمَاعَةِ الْمُسْلِمِينَ "

It was narrated from Abu Hayyan al-Taymi that his father said: Al-Rabi' ibn Khuthaym wrote his will: "In the name of Allah, the Most Gracious, the Ever-Merciful. This is what al-Rabi' ibn Khuthaym bequeaths, calling Allah to witness it — and Allah suffices as a witness and rewarder for His righteous servants — that I am pleased with Allah as Lord, with Islam as religion, and with Muhammad as Prophet. I command myself and those who obey me to worship Allah among the worshippers, to praise Him among those who praise, and to be sincere advisors to the Muslim community."

Hadith #2447Ungraded

حَدَّثَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ : " أَنَّ عَلِيًّا دَخَلَ عَلَى مَرِيضٍ، فَذَكَرُوا لَهُ الْوَصِيَّةَ، فَقال عَلِيٌّ :قَالَ اللَّهُ : # إِنْ تَرَكَ خَيْرًا سورة البقرة آية 180 #، وَلَا أُرَاهُ تَرَكَ خَيْرًا ". قَالَ حَمَّادٌ : فَحَفِظْتُ أَنَّهُ تَرَكَ أَكْثَرَ مِنْ سَبْعِ مِائَةٍ

It was narrated from Hisham that his father said: 'Ali (may Allah be pleased with him) visited a sick man, and they mentioned making a will to him. 'Ali said: "Allah says: {if he leaves some good} (Quran 2:180), and I do not see that he has left any good." Hammad said: "I recall that he had left more than seven hundred."

Hadith #2451Ungraded

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنْ عَامِرٍ ، عَنْ شُرَيْحٍ : " فِي الرَّجُلِ يُوصِي بِأَكْثَرَ مِنْ ثُلُثِهِ، قَالَ :إِنْ أَجَازَتْهُ الْوَرَثَةُ، أَجَزْنَاهُ، وَإِنْ قَالَتِ الْوَرَثَةُ : أَجَزْنَاهُ، فَهُمْ بِالْخِيَارِ إِذَا نَفَضُوا أَيْدِيَهُمْ مِنْ الْقَبْرِ "

It was narrated from Shurayh that he was asked about a man who bequeaths more than one-third of his estate. He said: "If the heirs approve it, we approve it — but if the heirs say 'we approved it,' they still have the option to retract once they finish burying him."

Hadith #2452Ungraded

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا الْمَسْعُودِيُّ ، عَنْ أَبِي عَوْنٍ ، عَنْ الْقَاسِمِ : " أَنَّ رَجُلًا اسْتَأْذَنَ وَرَثَتَهُ أَنْ يُوصِيَ بِأَكْثَرَ مِنَ الثُّلُثِ، فَأَذِنُوا لَهُ، ثُمَّ رَجَعُوا فِيهِ بَعْدَ مَا مَاتَ، فَسُئِلَ عَبْدُ اللَّهِ عَنْ ذَلِكَ، فَقَالَ :هَذَا التَّكَرُّهُ لَا يَجُوزُ "

It was narrated from al-Qasim that a man sought permission from his heirs to bequeath more than one-third, and they permitted him. Then after he died they retracted their approval. 'Abdullah (ibn Mas'ud, may Allah be pleased with him) was asked about this and said: "This grudging approval is not valid."

حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ، حَدَّثَنَا هَمَّامٌ ، حَدَّثَنَا قَتَادَةُ ، عَنْ يُونُسَ بْنِ جُبَيْرٍ ، عَنْ مُحَمَّدِ بْنِ سَعْدٍ ، عَنْ أَبِيهِ : أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دَخَلَ عَلَيْهِ وَهُوَ بِمَكَّةَ ، وَلَيْسَ لَهُ إِلَّا ابْنَةٌ، فَقُلْتُ لَهُ : " إِنَّهُ لَيْسَ لِي إِلَّا ابْنَةٌ وَاحِدَةٌ، فَأُوصِي بِمَالِي كُلِّهِ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : لَا، قُلْتُ : فَأُوصِي بِالنِّصْفِ؟ فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : لَا، قَالَ : فَأُوصِي بِالثُّلُثِ؟ قَالَ : فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :الثُّلُثُ، وَالثُّلُثُ كَثِيرٌ "

It was narrated from Muhammad ibn Sa'd, from his father Sa'd ibn Abi Waqqas (may Allah be pleased with him), that the Prophet ﷺ visited him in Makkah, and he had only one daughter. He said to him: "I have only one daughter — may I bequeath all my wealth?" The Prophet ﷺ said: "No." He asked: "May I bequeath half?" The Prophet ﷺ said: "No." He asked: "May I bequeath one-third?" The Messenger of Allah ﷺ said: "One-third — and one-third is much."

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاق ، عَنْ الزُّهْرِيِّ ، عَنْ عَامِرِ بْنِ سَعْدٍ ، عَنْ أَبِيهِ ، قَالَ : " اشْتَكَيْتُ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي حَجَّةِ الْوَدَاعِ حَتَّى أُدْنِفْتُ، فَدَخَلَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَعُودُنِي، فَقُلْتُ : يَا رَسُولَ اللَّهِ، مَا أُرَانِي إِلَّا أَلَمَّ بِي وَأَنَا ذُو مَالٍ كَثِيرٍ، وَإِنَّمَا يَرِثُنِي ابْنَةٌ لِي، أَفَأَتَصَدَّقُ بِمَالِي كُلِّهِ؟ قَالَ : لَا، قُلْتُ : فَبِنِصْفِهِ؟ قَال : لَا، قُلْتُ : فَالثُّلُثِ؟ قَالَ :الثُّلُثُ، وَالثُّلُثُ كَثِيرٌ، إِنَّكَ إِنْ تَتْرُكْ وَرَثَتَكَ أَغْنِيَاءَ، خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ فُقَرَاءَ يَتَكَفَّفُونَ النَّاسَ بِأَيْدِيهِمْ، وَإِنَّكَ لَا تُنْفِقُ نَفَقَةً إِلَّا آجَرَكَ اللَّهُ فِيهَا، حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ "

It was narrated from 'Amir ibn Sa'd, from his father Sa'd (may Allah be pleased with him), that he said: "I fell ill with the Prophet ﷺ during the Farewell Pilgrimage until I was gravely ill. The Messenger of Allah ﷺ came to visit me. I said: 'O Messenger of Allah, I see that death is coming for me, and I have much wealth but only a daughter to inherit from me. May I give all my wealth in charity?' He said: 'No.' I asked: 'Half of it?' He said: 'No.' I asked: 'One-third?' He said: 'One-third — and one-third is much. If you leave your heirs wealthy, that is better than leaving them poor, begging from people with outstretched hands. You will not spend any expenditure seeking Allah's pleasure except that Allah will reward you for it, even a morsel you put in your wife's mouth.'"

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ إِسْحَاق بْنِ سُوَيْدٍ ، عَنْ الْعَلَاءِ بْنِ زِيَادٍ : أَنَّ رَجُلًا سَأَلَ عُمَرَ بْنَ الْخَطَّابِ ، فَقَالَ : " إِنَّ وَارِثِي كَلَالَةٌ، فَأُوصِي بِالنِّصْفِ؟ قَالَ : لَا، قَالَ : فَالثُّلُثِ؟ قَالَ : لَا، قَالَ : فَالرُّبُع؟ قَالَ : لَا، قَالَ : فَالْخُمُس؟ قَالَ : لَا، حَتَّى صَارَ إِلَى الْعُشْرِ، فَقَالَ :أَوْصِ بِالْعُشْرِ "

It was narrated from al-'Ala' ibn Ziyad that a man asked 'Umar ibn al-Khattab (may Allah be pleased with him): "My heirs are distant relatives (kalala) — may I bequeath half?" He said: "No." The man asked: "One-third?" He said: "No." He asked: "One-quarter?" He said: "No." He asked: "One-fifth?" He said: "No." This continued until they reached one-tenth. 'Umar said: "Bequeath one-tenth."

أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ ، عَنْ عِكْرِمَةَ شَيْخٍ مِنْ أَهْلِ دِمَشْقَ ، قَالَ : " كُنْتُ عِنْدَ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، وَعِنْدَهُ سُلَيْمَانُ بْنُ حَبِيبٍ، وَأَبُو قِلَابَةَ ، إِذْ دَخَلَ غُلَامٌ، فَقَالَ :أَرْضُنَا بِمَكَانِ كَذَا وَكَذَا، بَاعَكُمْ الْوَصِيُّ وَنَحْنُ أَطْفَالٌ، فَالْتَفَتَ إِلَى سُلَيْمَانَ بْنِ حَبِيبٍ، فَقَالَ : مَا تَقُولُ؟ قَالَ : فَأَضْجَعَ فِي الْقَوْلِ، فَالْتَفَتَ إِلَى أَبِي قِلَابَةَ، فَقَالَ : مَا تَقُولُ؟ قَالَ : رُدَّ عَلَى الْغُلَامِ أَرْضَهُ، قَالَ : إِذًا يَهْلِكُ مَالُنَا؟ قَالَ : أَنْتَ أَهْلَكْتَهُ "

It was narrated from 'Ikrima, a scholar from Damascus, that he said: "I was with 'Umar ibn 'Abd al-'Aziz, and with him were Sulayman ibn Habib and Abu Qilaba, when a young man entered and said: 'Our land in such and such a place — the executor sold it when we were children.' 'Umar turned to Sulayman ibn Habib and said: 'What do you say?' He gave an evasive answer. 'Umar then turned to Abu Qilaba and said: 'What do you say?' He replied: 'Return the land to the young man.' 'Umar asked: 'Then our wealth will be lost?' Abu Qilaba said: 'You are the one who caused it to be lost.'"

حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ ، حَدَّثَنَا هَمَّامٌ ، قَالَ : حَدَّثَنِي قَتَادَةُ ، قَالَ : حَدَّثَنِي عَمْرُو بْنُ دِينَارٍ : " أَنَّ أَبَاهُ أَعْتَقَ رَقِيقًا لَهُ فِي مَرَضِهِ، ثُمَّ بَدَا لَهُ أَنْ يَرُدَّهُمْ وَيُعْتِقَ غَيْرَهُمْ، قَالَ : فَخَاصَمُونِي إِلَى عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ ،فَأَجَازَ عِتْقَ الْآخِرِينَ، وَأَبْطَلَ عِتْقَ الْأَوَّلِينَ "

It was narrated from 'Amr ibn Dinar that his father freed some of his slaves during his illness, then changed his mind and wanted to return them and free others instead. They disputed before 'Abd al-Malik ibn Marwan, who upheld the manumission of the latter group and invalidated the manumission of the first group.

حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ ، حَدَّثَنَا هَمَّامٌ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ ، عَنْ الشَّرِيدِ بْنِ سُوَيْدٍ ، قَالَ : قَالَ عُمَرُ :" يُحْدِثُ الرَّجُلُ فِي وَصِيَّتِهِ مَا شَاءَ، وَمِلَاكُ الْوَصِيَّةِ آخِرُهَا ". قَالَ أَبُو مُحَمَّد : هَمَّامٌ لَمْ يَسْمَعْ مِنْ عَمْرٍو، وَبَيْنَهُمَا قَتَادَةُ

It was narrated from al-Sharid ibn Suwayd that 'Umar (may Allah be pleased with him) said: "A man may make whatever changes he wishes in his will, and the binding part of a will is its final version."

Hadith #2478Ungraded

حَدَّثَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ يَحْيَى هُوَ ابْنُ سَعِيدٍ ، قَالَ : أَعْطَتِ امْرَأَةٌ مِنْ أَهْلِنَا وَهِيَ حَامِلٌ، فَسُئِلَ الْقَاسِمُ ، فَقَالَ : " هُوَ مِنْ جَمِيعِ الْمَالِ، قَالَ يَحْيَى : وَنَحْنُ نَقُولُ :إِذَا ضَرَبَهَا الْمَخَاضُ فَمَا أَعْطَتْ، فَمِنْ الثُّلُثِ "

It was narrated from Yahya ibn Sa'id that a woman from his family gave something away while pregnant. Al-Qasim was consulted and said: "It comes from all the estate." Yahya said: "Our view is: when labor pains begin, whatever she gives comes from the one-third."

Hadith #2479Ungraded

حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا أَبُو شِهَابٍ ، عَنْ عَمْرٍو ، عَنْ الْحَسَنِ : " فِي رَجُلٍ قَالَ لِغُلَامِهِ : إِنْ دَخَلْتُ دَارَ فُلَانٍ، فَغُلَامِي حُرٌّ، ثُمَّ دَخَلَهَا وَهُوَ مَرِيضٌ، قَالَ :يُعْتَقُ مِنْ الثُّلُثِ، وَإِنْ دَخَلَ فِي صِحَّتِهِ، عُتِقَ مِنْ جَمِيعِ الْمَالِ "

It was narrated from al-Hasan that he was asked about a man who said to his slave: "If I enter the house of so-and-so, then my slave is free" — then he entered it while ill. He said: "The slave is freed from one-third. But if he entered it while healthy, the slave is freed from the whole estate."

حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ، حَدَّثَنَا أَبُو شِهَابٍ عَبْدُ رَبِّهِ بْنُ نَافِعٍ ، عَنْ الْأَعْمَشِ ، عَنْ إِبْرَاهِيمَ ، قَالَ :" إِذَا أَوْصَى الرَّجُلُ بِالثُّلُثِ، وَالرُّبُعِ، فَفِي الْعَيْنِ وَالدَّيْنِ، وَإِذَا أَوْصَى بِخَمْسِينَ أَوْ سِتِّينَ إِلَى الْمِائَةِ، فَفِي الْعَيْنِ حَتَّى يَبْلُغَ الثُّلُثَ "

It was narrated from Ibrahim that he said: "If a man bequeaths one-third or one-quarter, it is taken from both cash assets and debts owed to him. If he bequeaths fifty or sixty up to one hundred, it is taken from cash assets up to the amount of one-third."

حَدَّثَنَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ ، حَدَّثَنَا شُعْبَةُ ، حَدَّثَنَا أَبُو إِسْحَاق ، عَنْ أَبِي حَبِيبَةَ ، قَالَ : سَأَلْتُ أَبَا الدَّرْدَاءِ عَنْ رَجُلٍ جَعَلَ دَرَاهِمَ فِي سَبِيلِ اللَّهِ، فَقَالَ أَبُو الدَّرْدَاءِ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" مَثَلُ الَّذِي يَتَصَدَّقُ عِنْدَ مَوْتِهِ أَوْ يُعْتِقُ، كَالَّذِي يُهْدِي بَعْدَ مَا شَبِعَ "

It was narrated from Abu Habiba that he said: I asked Abu al-Darda' (may Allah be pleased with him) about a man who devoted money to the cause of Allah, and Abu al-Darda' said: The Messenger of Allah ﷺ said: "The parable of one who gives charity at the time of his death, or frees a slave, is like one who gives a gift after he has already eaten his fill."
