أَخْبَرَنَا مَرْوَانُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا سَعِيدٌ ، عَنْ مَكْحُولٍ ، قَالَ :" إِذَا تَصَدَّقَ الرَّجُلُ عَلَى بَعْضِ وَرَثَتِهِ وَهُوَ صَحِيحٌ بِ

أَكْثَرَ مِنْ النِّصْفِ، رُدَّ إِلَى الثُّلُثِ، وَإِذَا أَعْطَى النِّصْفَ، جَازَ لَهُ ذَلِكَ ". قَالَ سَعِيدٌ : وَكَانَ قُضَاةُ أَهْلِ دِمَشْقَ يَقْضُونَ بِذَلِكَ

English Translation
It was narrated from Makhul that he said: "If a man gives charity to some of his heirs while he is healthy — giving more than half — it is reduced to one-third. If he gives half, that is permissible for him." Sa'id said: "The judges of Damascus used to rule according to this."
