حَدَّثَنَا عَمْرُو بْنُ عَوْنٍ ، عَنْ خَالِدِ بْنِ عَبْدِ اللَّهِ ، عَنْ يَحْيَى بْنِ أَبِي إِسْحَاق ، قَالَ : " سَأَلْتُ الْقَاسِمَ بْنَ عَبْدِ الرَّحْمَنِ ، وَمُعَاوِيَةَ بْنَ قُر

َّةَ عَنْ رَجُلٍ قَالَ فِي وَصِيَّتِهِ : " كُلُّ لِي حُرٌّ، وَلَهُ مَمْلُوكٌ آبِقٌ، فَقَالَا :هُوَ حُرٌّ "، قَالَ الْحَسَنُ ، وَإِيَاسٌ ، وَبَكْرُ بْنُ عَبْدِ اللَّهِ : ليس بحر

English Translation

It was narrated from Yahya ibn Abi Ishaq that he said: I asked al-Qasim ibn 'Abd al-Rahman and Mu'awiya ibn Qurra about a man who said in his will: "Everything I own is free," and he had a runaway slave. They both said: "He is free." Al-Hasan, Iyas, and Bakr ibn 'Abdullah said: "He is not free."
