حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ حَدَّثَنِي يُونُسُ عَنِ الزُّهْرِيِّ عَنْ يَزِيدَ بْنِ هُرْمُزَ أَنَّ نَجْدَةَ الْحَرُورِيَّ حِينَ خَرَجَ مِنْ فِتْن
َةِ ابْنِ الزُّبَيْرِ أَرْسَلَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ سَهْمِ ذِي الْقُرْبَى لِمَنْ تَرَاهُ قَالَ هُوَ لَنَا لِقُرْبَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَسَمَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَهُمْ وَقَدْ كَانَ عُمَرُ عَرَضَ عَلَيْنَا مِنْهُ شَيْئًا رَأَيْنَاهُ دُونَ حَقِّنَا فَرَدَدْنَاهُ عَلَيْهِ وَأَبَيْنَا أَنْ نَقْبَلَهُ وَكَانَ الَّذِي عَرَضَ عَلَيْهِمْ أَنْ يُعِينَ نَاكِحَهُمْ وَأَنْ يَقْضِيَ عَنْ غَارِمِهِمْ وَأَنْ يُعْطِيَ فَقِيرَهُمْ وَأَبَى أَنْ يَزِيدَهُمْ عَلَى ذَلِكَ

English Translation
Uthman ibn 'Umar narrated to us, Yunus narrated to me, from al-Zuhri, from Yazid ibn Hurmuz that Najdah al-Haruri, when he emerged during the fitnah of Ibn al-Zubayr, sent a message to Ibn 'Abbas رضي الله عنهما asking him about the share of dhawi al-qurba (near relatives of the Prophet ﷺ) and to whom it belongs, and about giving women and slaves a share of the spoils, and about killing children in war. Ibn 'Abbas wrote back: 'You have written asking about the share of dhawi al-qurba. It belongs to us, the relatives of the Messenger of Allah ﷺ. 'Umar offered to marry off our unmarried from it and to pay debts of our debtors and to give to our poor, but we refused except to take it in full, and he refused that.' And regarding women and slaves: 'They were not given a combatant's share, but they were given a provision (radhkh).' And regarding killing children: 'the Messenger of Allah ﷺ did not kill them, and you should not kill them unless you know what the boy of al-Khidr knew.'
