حَدَّثَنَا بَهْزٌ حَدَّثَنَا هَمَّامٌ أَنْبَأَنَا قَتَادَةُ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا أَسْوَدَ يُسَمَّى مُغِيثًا وَكُنْتُ أَرَاهُ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ عَلَيْهَا قَالَ فَقَضَى فِيهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْبَعَ قَضِيَّاتٍ قَضَى أَنّ
َ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا وَأَمَرَهَا أَنْ تَعْتَدَّ قَالَ هَمَّامٌ مَرَّةً عِدَّةَ الْحُرَّةِ قَالَ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ فَأَهْدَتْ مِنْهَا إِلَى عَائِشَةَ فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ هُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ

English Translation
It was narrated from Ibn 'Abbas (رضي الله عنهما) — via 'Ikrimah — that the husband of Barirah was a black slave named Mughith. Ibn 'Abbas said: 'I used to see him following her through the streets of Madinah, weeping.' the Prophet ﷺ gave four rulings in her case: he ruled that wala' [patronage] belongs to the one who freed her; he gave her the choice [to remain with or leave her husband]; he commanded her to observe 'iddah — Hammam once said: the 'iddah of a free woman; and she had been given a gift of charity which she gifted to 'A'ishah. When this was mentioned to the Prophet ﷺ, he said: 'It is charity for her and a gift for us.'
