حَدَّثَنَا عَفَّانُ حَدَّثَنَا جَرِيرُ بْنُ حَازِمٍ سَمِعْتُ نَافِعًا حَدَّثَنَا ابْنُ

عُمَرَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي عَبْدٍ فَإِنْ كَانَ لَهُ مِنْ الْمَالِ مَا يَبْلُغُ قِيمَتَهُ قُوِّمَ عَلَيْهِ قِيمَةَ عَدْلٍ وَإِلَّا فَقَدْ أَعْتَقَ مَا أَعْتَقَ

English Translation

It was narrated from Ibn 'Umar (رضي الله عنهما) — via 'Affan, from Jarir ibn Hazim — that he heard Nafi' narrate from Ibn 'Umar — that the Messenger of Allah ﷺ said: 'Whoever frees his share of a jointly-owned slave — if he has wealth sufficient to cover [the rest of] his value, the slave is to be assessed at a fair price [and his partner compensated accordingly]. Otherwise, he has freed only the portion he freed.'
