حَدَّثَنَا يَحْيَى عَنْ حُسَيْنٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ لَمَّا فُتِحَتْ مَكَّةُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ كُفُّوا السِّلَاحَ إِلَّا خُزَاعَةَ عَنْ بَنِي بَكْرٍ فَأَذِنَ لَهُمْ حَتَّى صَلَّى الْعَصْرَ ثُمَّ قَالَ كُفُّوا السِّلَاحَ فَلَقِيَ رَجُلٌ مِنْ خُزَاعَةَ رَجُلًا مِنْ بَنِي بَكْرٍ مِنْ غَدٍ بِالْمُزْدَلِفَةِ فَقَتَلَهُ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَامَ خَطِيبًا فَقَالَ وَرَأَيْتُهُ وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ قَالَ إِنَّ أَعْدَى النَّاسِ عَلَى اللَّهِ مَنْ قَتَلَ فِي الْحَرَمِ أَوْ قَتَلَ غَيْرَ قَاتِلِهِ أَوْ قَتَلَ بِذُحُولِ الْجَاهِلِيَّةِ
فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ إِنَّ فُلَانًا ابْنِي فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا دَعْوَةَ فِي الْإِسْلَامِ ذَهَبَ أَمْرُ الْجَاهِلِيَّةِ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْأَثْلَبُ قَالُوا وَمَا الْأَثْلَبُ قَالَ الْحَجَرُ قَالَ وَفِي الْأَصَابِعِ عَشْرٌ عَشْرٌ وَفِي الْمَوَاضِحِ خَمْسٌ خَمْسٌ قَالَ وَقَالَ لَا صَلَاةَ بَعْدَ الْغَدَاةِ حَتَّى تَطْلُعَ الشَّمْسُ وَلَا صَلَاةَ بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ قَالَ وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا يَجُوزُ لِامْرَأَةٍ عَطِيَّةٌ إِلَّا بِإِذْنِ زَوْجِهَا
Isnad Chain
English Translation
It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Yahya, from Husayn, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that he said: 'When Mecca was conquered by the Messenger of Allah ﷺ, he said: "Put down your weapons — except Khuza'a [who may continue] against Banu Bakr" — and he permitted them until he had prayed 'Asr, then said: "Put down your weapons." The next day a man from Khuza'a met a man from Banu Bakr at Muzdalifah and killed him. This reached the Messenger of Allah ﷺ and he stood to give a sermon — I saw him leaning his back against the Ka'bah. He said: "The most hostile of people toward Allah is: one who kills within the Sacred Precinct [al-Haram], one who kills someone other than his own killer, or one who kills out of pre-Islamic vendettas [dhuyul al-jahiliyyah]." A man stood and said: "So-and-so is my son." the Messenger of Allah ﷺ said: "There is no [lineage] claim [by fornication] in Islam — the pre-Islamic era's custom has passed. The child belongs to the marital bed, and to the fornicator belongs the stone [al-athlab]." They said: "What is al-athlab?" He said: "The stone." He also said: "For fingers, ten [camels each] — and for al-mawadih [blows exposing bone], five [camels] each." And he said: "There is no prayer after Fajr until the sun rises, and no prayer after 'Asr until the sun sets." And: "A woman may not be married while her paternal aunt is [already] in the marriage, nor while her maternal aunt is [in the marriage]. And a woman's gift is not valid except with the permission of her husband."'
