Chain of Narration (Isnad)

حَدَّثَنَا الْحُسَيْنُ حَدَّثَنِي ابْنُ أَبِي الزِّنَادِ عَنْ عَبْدِ الرَّحْمَنِ يَعْنِي ابْنَ الْحَارِثِ أَخْبَرَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّهُ سَمِعَ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَاذَا تَقُولُ يَا رَسُولَ اللَّهِ فِي ضَالَّةِ الْإِبِلِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا لَكَ وَلَهَا مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا قَالَ فَضَالَّةُ الْغَنَمِ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَمَنْ أَخَذَهَا مِنْ مَرْتَعِهَا قَالَ عُوقِبَ وَغُرِّمَ مِثْلَ ثَمَنِهَا وَمَنْ اسْتَطْلَقَهَا مِنْ عِقَالٍ أَوْ اسْتَخْرَجَهَا مِنْ حِفْشٍ وَهِيَ الْمَظَالُّ فَعَلَيْه

ِ الْقَطْعُ قَالَ يَا رَسُولَ اللَّهِ فَالثَّمَرُ يُصَابُ فِي أَكْمَامِهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيْسَ عَلَى آكِلٍ سَبِيلٌ فَمَنْ اتَّخَذَ خُبْنَةً غُرِّمَ مِثْلَ ثَمَنِهَا وَعُوقِبَ وَمَنْ أَخَذَ شَيْئًا مِنْهَا بَعْدَ أَنْ أَوَى إِلَى مِرْبَدٍ أَوْ كَسَرَ عَنْهَا بَابًا فَبَلَغَ مَا يَأْخُذُ ثَمَنَ الْمِجَنِّ فَعَلَيْهِ الْقَطْعُ قَالَ يَا رَسُولَ اللَّهِ فَالْكَنْزُ نَجِدُهُ فِي الْخَرِبِ وَفِي الْآرَامِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ

رجلا من مزينة سأل رسول الله

English Translation

It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Waki', from Sufyan, from 'Amr ibn 'Uthman, from al-Maqburi, from 'Amr ibn Shu'ayb, from his father, from his grandfather — from the Prophet ﷺ on stray animals: he said about a stray camel: 'It has its own footwear [hooves] and water vessel [stomach] — it eats from trees and drinks from rivers. Leave it until its owner finds it.' About a stray sheep: 'It is for you, your brother, or the wolf — gather them until their owner comes.' And he said about [an animal] stolen from its pasture [harisa]: 'There is [compensation of] its value twice and flogging and disciplinary punishment [nakala]. And what is taken from the [enclosed] fold — in that, the hand is cut when what is taken reaches the value of a shield.' And about fruits still on trees: 'Whoever eats with his mouth without filling his garment — nothing is upon him. And what is taken from the threshing floor — in that, the hand is cut when what is taken reaches the value of a shield.'
