حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ قَالَ ذَكَرَ

عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي عَقْلِ الْجَنِينِ إِذَا كَانَ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ فَقَضَى بِذَلِكَ فِي امْرَأَةِ حَمَلِ بْنِ مَالِكِ بْنِ النَّابِغَةِ الْهُذَلِيِّ

English Translation

It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Ya'qub, from his father, from Ibn Ishaq, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that the Messenger of Allah ﷺ ruled, regarding the blood money ['aql] for a fetus [killed] in its mother's womb, that it is a ghurra — a male or female slave. This ruling was given in the case of the wife of Hamal ibn Malik ibn al-Nabigha al-Hudhali.
