Hadith #544

English Translation

Yaʿqūb narrated to us, he said: My father narrated to us, from Ibn Isḥāq, he said: Saʿīd ibn Abī Saʿīd al-Maqburī narrated to me, from Abū Shurayḥ al-Khuzāʿī who said: When ʿAmr ibn Saʿīd sent an expedition to Makkah to fight against Ibn al-Zubayr, Abū Shurayḥ came to him and told him what he had heard from the Messenger of Allāh ﷺ. Then he went to the gathering of his people, and I went and sat with him. He told his people what he had told ʿAmr ibn Saʿīd of what he had heard from the Messenger of Allāh ﷺ and what ʿAmr ibn Saʿīd had said to him. He said: I told him: We were with the Messenger of Allāh ﷺ when he conquered Makkah. The day after the conquest, Khuzāʿah attacked a man from Hudhayl and killed him while he was a polytheist. The Messenger of Allāh ﷺ stood among us as a speaker and said: 'O people, Allāh عز وجل made Makkah sacred the day He created the heavens and the earth. It is sacred by the sanctity of Allāh تعالى until the Day of Resurrection. It is not lawful for any person who believes in Allāh and the Last Day to shed blood in it or cut down a tree in it. It was not permitted for anyone before me, and it will not be permitted for anyone after me. It was only permitted to me for this hour, out of anger against its people. Indeed, it has returned to its sanctity as it was yesterday. Let those present convey to those absent. Whoever tells you that the Messenger of Allāh ﷺ fought in it, say: Allāh عز وجل permitted it for His Messenger but did not permit it for you. O people of Khuzāʿah, lift your hands from killing, for there has been too much of it. If you kill anyone, I will pay his blood money. Whoever is killed after this speech of mine, his family has the choice of the better of two options: either the blood of his killer or his blood money.' Then the Messenger of Allāh ﷺ paid the blood money for the man whom Khuzāʿah had killed. ʿAmr ibn Saʿīd said to Abū Shurayḥ: Go on your way, old man. We know more about its sanctity than you. It does not protect a blood-shedder, nor one who rebels against authority, nor one who withholds tribute. He said: I said to him: I was there and you were absent. I have conveyed the message. The Messenger of Allāh ﷺ commanded that those who were present convey to those who were absent. I have conveyed it to you, and you and your affair.
