حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَنَا ابْنُ جُرَيْجٍ قَالَ أَنَا عَمْرُو بْنُ دِينَارٍ أَنَّهُ سَمِعَ طَاوُسًا يُخْبِرُ عَنِ ابْنِ عَبَّاسٍ عَنْ عُمَرَ رَضِيَ اللَّهُ تَعَالَى عَنْهُ أَنَّهُ نَشَدَ قَضَاءَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ فَجَاءَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ فَقَالَ كُنْتُ بَيْنَ بَيْتَيْ امْرَأ
َتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا قُلْتُ لِعَمْرٍو لَا أَخْبَرَنِي عَنْ أَبِيهِ بِكَذَا وَكَذَا قَالَ لَقَدْ شَكَّكْتَنِي

English Translation
ʿAbd al-Razzāq narrated to us, he said: Ibn Jurayj informed us, he said: ʿAmr ibn Dīnār informed us that he heard Ṭāwūs relate from Ibn ʿAbbās, from ʿUmar رضي الله عنه, that he asked about the judgment of the Messenger of Allāh ﷺ regarding that matter. Ḥamal ibn Mālik ibn al-Nābighah came and said: I was between the houses of my two wives when one of them struck the other with a tent-pole and killed her and her unborn child. the Prophet ﷺ ruled that the compensation for the unborn child was a ghurrah (a male or female slave), and that she (the killer) should be executed for the killing. I said to ʿAmr, 'Did he not inform us from his father differently?' He said, 'You have made me doubt.'
