حَدَّثَنَا بَهْزٌ وَعَفَّانُ قَالَا حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ حَدَّثَنِي عَقِيلُ بْنُ طَلْحَةَ قَالَ عَفَّانُ فِي حَدِيثِهِ أَنَا عَقِيلُ بْنُ طَلْحَةَ السُّلَمِيُّ عَنْ مُسْلِمِ بْنِ هَيْضَمٍ عَنِ الْأَشْعَثِ بْنِ قَيْسٍ أَنَّهُ قَالَ أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي وَفْدٍ مِنْ كِنْدَةَ قَالَ عَفَّانُ لَا يَرَوْنِي
إِلَّا أَفْضَلَهُمْ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنَّا نَزْعُمُ أَنَّكُمْ مِنَّا قَالَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْنُ بَنُو النَّضْرِ بْنُ كِنَانَةَ لَا نَقْفُو أُمَّنَا وَلَا نَنْتَفِي مِنْ أَبِينَا قَالَ قَالَ الْأَشْعَثُ فَوَاللَّهِ لَا أَسْمَعُ أَحَدًا نَفَى قُرَيْشًا مِنْ النَّضْرِ بْنِ كِنَانَةَ إِلَّا جَلَدْتُهُ الْحَدَّ

English Translation
It was narrated from al-Ash'ath ibn Qays (may Allah be pleased with him) that a man from Kinda and a man from Hadramawt disputed before the Messenger of Allah ﷺ over some land in Yemen. The man from Hadramawt said: 'O Messenger of Allah, this man's father seized my land and it is now in his possession.' The Prophet ﷺ said to the Kindi: 'Do you have a proof?' He said: 'No.' He said: 'Then you must take an oath.' He said: 'O Messenger of Allah, he is a liar — he will swear.' The Prophet ﷺ said: 'Whoever swears a false oath to seize someone's property will meet Allah while He is angry with him and has prepared for him the Hellfire.' The man said: 'What is in it for him, O Messenger of Allah?' He said: 'Nothing.' So he took the oath and received the land.
