Hadith #286
Arabic Text
حَدَّثَنَا يَحْيَى بْنُ إِسْحَاقَ أَخْبَرَنَا ابْنُ لَهِيعَةَ عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي جَعْفَرٍ عَنِ الْفَضْلِ بْنِ عَمْرِو بْنِ أُمَيَّةَ
عَنْ أَبِيهِ قَالَ سَمِعْتُ رِجَالًا يَتَحَدَّثُونَ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِذَا عُتِقَتْ الْأَمَةُ فَهِيَ بِالْخِيَارِ مَا لَمْ يَطَأْهَا إِنْ شَاءَتْ فَارَقَتْهُ وَإِنْ وَطِئَهَا فَلَا خِيَارَ لَهَا وَلَا تَسْتَطِيعُ فِرَاقَهُ

English Translation
It was narrated from some Companions of the Prophet ﷺ that the Messenger of Allah ﷺ said: 'When a slave woman is freed, she has the choice as long as her husband has not yet had relations with her. If she wishes, she may leave him. But if he has had relations with her, she has no choice and cannot leave him.'
