أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، عَنْ مُوسَى بْنِ عُبَيْدَةَ ، عَنْ نَافِعٍ ، عَنْ ابْنِ عُمَرَ ، قَالَ :" إِذَا تَلَاع

َنَا، فُرِّقَ بَيْنَهُمَا وَلَمْ يَجْتَمِعَا، وَدُعِيَ الْوَلَدُ لِأُمِّهِ، يُقَالُ : ابْنُ فُلَانَةَ، هِيَ عَصَبَتُهُ يَرِثُهَا وَتَرِثُهُ، وَمَنْ دَعَاهُ لِزِنْيَةٍ، جُلِدَ "

English Translation

It was narrated from Nafi', from Ibn Umar (may Allah be pleased with him), that he said: 'When a couple invoke mutual imprecation, they are separated and may never reunite. The child is called by his mother's name — he is called son of so-and-so (his mother's name). She is his residual heir; he inherits from her and she inherits from him. And whoever accuses him of being illegitimate is flogged.'
