حَدَّثَنَا يَحْيَى بْنُ حَسَّانَ ، حَدَّثَنَا ابْنُ أَبِي الزِّنَادِ ، عَنْ أَبِيهِ ، عَن

ْ خَارِجَةَ بْنِ زَيْدٍ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، قَالَ :" كُلُّ قَوْمٍ مُتَوَارِثِينَ عَمِيَ مَوْتُهُمْ فِي هَدْمٍ، أَوْ غَرَقٍ، فَإِنَّهُمْ لَا يَتَوَارَثُونَ، يَرِثُهُمْ الْأَحْيَاءُ "

English Translation

It was narrated from Kharija ibn Zayd, from Zayd ibn Thabit (may Allah be pleased with him), that he said: 'If a group of mutual heirs die together in a collapsed structure or drowning and the order of their deaths is unknown, they do not inherit from each other — rather, the living heirs inherit from them.'
