English Translation

It was narrated from 'Abdullah ibn Mas'ud (رضي الله عنه) — via Yahya ibn Sa'id, from Hisham, from Qatada, from Khilas, from 'Abdillah ibn 'Utba — that he said: ''Abdullah ibn Mas'ud was asked about a man who married a woman without specifying a dowry [mahr] for her, then died before consummating [the marriage]. He did not give an opinion. They left, then returned and asked him again. He said: I will give my best judgment. If I am correct, Allah (عز وجل) has guided me to it; if I err, it is from me. She gets the customary dowry of women like her [mahr al-mithl], she inherits [from him], and she must observe 'idda. A man from [the tribe of] Ashja' stood up and said: I bear witness that the Prophet ﷺ gave exactly that ruling. He ['Abdullah] said: Bring someone to testify to that. Abu al-Jarrah testified to it.' — [A second chain] via 'Abd al-Malik ibn 'Amr, from Hisham — the same meaning, except he specified it was in the case of Barwa' bint Washiq — and he ['Abdullah] said: Bring your two witnesses to this. So Abu Sinan and al-Jarrah — two men from Ashja' — testified to it.
