حَدَّثَنَا أَبُو النَّضْرِ وعَبْدُ الصَّمَدِ قَالَا حَدَّثَنَا مُحَمَّدٌ حَدَّثَنَا سُلَيْمَانُ يَعْنِي ابْنَ مُوسَى عَنْ عَمْرِو
بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قَتَلَ مُتَعَمِّدًا دُفِعَ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوهُ وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صَالَحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ
English Translation
It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Abu al-Nadr and 'Abd al-Samad, from Muhammad ibn Rashid, from Sulayman ibn Musa, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that the Prophet ﷺ said: 'Whoever kills intentionally is handed over to the heirs of the slain. If they wish, they execute him. If they wish, they accept the blood money — which is thirty hiqqah [three-year-old female camels], thirty jad'a [four-year-old camels], and forty khalifa [pregnant camels]. That is the blood money for intentional killing ['aql al-'amd]. Whatever they settle upon [beyond the mandated amount] is for them. This is the enhanced blood money.'
