English Translation

It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Hashim ibn al-Qasim, from Muhammad ibn Rashid, from Sulayman ibn Musa, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that the Messenger of Allah ﷺ ruled: Every [child] whose paternity is claimed [mustalhaq] after the death of the father in whose name the claim is made — if the deceased's heirs make the claim on his behalf — then: If the child is from a slave-woman the father owned on the day he had relations with her, then [the child] is affiliated to the one who claimed him. He is not entitled to any inheritance already distributed before his claim, but he receives his share of any inheritance not yet distributed. He is not affiliated [to the deceased] if the attributed father denied him during his life. If the child is from a slave-woman the man did not own, or from a free woman he committed fornication with — he is not affiliated and does not inherit, even if the attributed father himself was the claimant. Such a child is a child of fornication — belonging to the family of his mother, whether they be free or slave.
