English Translation

It was narrated from Abu Hurayra (رضي الله عنه) — via 'Abd al-Razzaq, from Ma'mar, from al-Zuhri, from Abu Salama — that two women from [the tribe of] Hudhayl fought, and one of them threw a stone at the other and struck her belly, killing her and causing her to miscarry a fetus. the Messenger of Allah ﷺ ruled that her blood money [diya] was upon the 'aqila [the responsible kin-group of the killer], and for the fetus a ghurra — a male or female slave. Someone objected: 'How can blood money be paid for one who did not eat, drink, speak, or cry out [at birth]? Something like this should go unavenged.' the Prophet ﷺ said [to Abu Hurayra]: 'This man is of the brothers of the soothsayers!' [i.e., his rhyming, rhythmic speech resembles the saj' of fortune-tellers].
