حَدَّثَنَا أَبُو دَاوُدَ حَدَّثَنَا هِشَامٌ عَنْ قَتَادَةَ عَنْ خِلَاسٍ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ قَالَ أَتَى ابْنُ مَسْعُودٍ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا وَلَمْ يَدْخُلْ بِهَا فَسُئِلَ عَنْهَا شَهْرًا فَلَمْ يَقُلْ فِيهَا شَيْئًا ثُمَّ سَأَلُوهُ فَقَالَ أَقُولُ فِيهَا بِرَأْيِي فَإِنْ يَكُ خَطَأً فَمِنِّي وَمِنْ الشَّيْطَانِ وَإِنْ يَكُ صَو
َابًا فَمِنْ اللَّهِ لَهَا صَدَقَةُ إِحْدَى نِسَائِهَا وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ أَشْهَدُ لَقَضَيْتَ فِيهَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي بِرْوَعَ ابْنَةِ وَاشِقٍ قَالَ فَقَالَ هَلُمَّ شَاهِدَاكَ فَشَهِدَ لَهُ الْجَرَّاحُ وَأَبُو سِنَانٍ رَجُلَانِ مِنْ أَشْجَعَ

English Translation
Abū Dāwūd narrated to us: Hishām narrated to us, from Qatādah, from Khilās, from ʿAbdullāh ibn ʿUtbah who said: Ibn Masʿūd was approached regarding a man who married a woman, then died without having set a dowry for her or consummated the marriage. He was asked about it for a month but said nothing. Then they asked him again, and he said: 'I shall give my opinion in this. If it is wrong, it is from me and from Shayṭān; and if it is correct, it is from Allah. She receives the dowry of one of her peers, she inherits, and she must observe the waiting period.' A man from Ashjaʿ stood and said: 'I testify that you have judged with the judgment of the Messenger of Allah ﷺ regarding Birwaʿ bint Wāshiq.' He said: 'Bring your two witnesses.' So al-Jarrāḥ and Abū Sinān testified — two men from Ashjaʿ.
