حَدَّثَنَا عَارِمٌ حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ عَنْ أَبِيهِ قَالَ وَحَدَّثَنِي السُّمَيْطُ الشَّيْبَانِيُّ عَنْ أَبِي الْعَلَاءِ قَالَ حَدَّثَنِي رَجُلٌ مِنْ الْحَيِّ أَنَّ عِمْرَانَ بْنَ حُصَيْنٍ حَدَّثَهُ أَنَّ عُبَيْسًا أَوْ ابْنَ عُبَيْسٍ فِي أُنَاسٍ مِنْ بَنِي جُشَمٍ أَتَوْهُ فَقَالَ لَهُ أَحَدُهُمْ أَلَا تُقَاتِلُ حَتَّى لَا تَكُونَ فِتْنَةٌ قَالَ لَعَلِّي قَدْ قَاتَلْتُ حَتَّى لَمْ تَكُنْ فِتْنَةٌ قَالَ أَلَا أُحَدِّثُكُمْ مَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا أُرَاهُ يَنْفَعُكُمْ فَأَنْصِتُوا قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اغْزُوا بَنِي فُلَانٍ مَعَ فُلَانٍ قَالَ فَصُفَّتْ الرِّجَالُ وَكَانَتْ النِّسَاءُ مِنْ وَرَاءِ الرِّجَالِ ثُمَّ لَمَّا رَجَعُوا قَالَ رَجُلٌ يَا نَبِيَّ اللَّهِ اسْتَغْفِرْ لِي غَفَرَ اللَّهُ لَكَ قَالَ هَلْ أَحْدَثْتَ قَالَ لَمَّا هُزِمَ الْقَوْمُ وَجَدْتُ رَجُلًا بَيْنَ الْقَوْمِ وَالنِّسَاءِ فَقَالَ إِنِّي مُسْلِمٌ أَوْ قَالَ أَسْلَمْتُ فَقَتَلْتُهُ قَالَ تَعَوُّذًا بِذَلِكَ حِينَ غَشِيَهُ الرُّمْحُ قَالَ هَلْ شَقَقْتَ عَنْ قَلْبِهِ تَنْظُ
رُ إِلَيْهِ فَقَالَ لَا وَاللَّهِ مَا فَعَلْتُ فَلَمْ يَسْتَغْفِرْ لَهُ أَوْ كَمَا قَالَ وَقَالَ فِي حَدِيثِهِ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اغْزُوا بَنِي فُلَانٍ مَعَ فُلَانٍ فَانْطَلَقَ رَجُلٌ مِنْ لُحْمَتِي مَعَهُمْ فَلَمَّا رَجَعَ إِلَى نَبِيِّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ يَا نَبِيَّ اللَّهِ اسْتَغْفِرْ اللَّهَ لِي غَفَرَ اللَّهُ لَكَ قَالَ وَهَلْ أَحْدَثْتَ قَالَ لَمَّا هُزِمَ الْقَوْمُ أَدْرَكْتُ رَجُلَيْنِ بَيْنَ الْقَوْمِ وَالنِّسَاءِ فَقَالَا إِنَّا مُسْلِمَانِ أَوْ قَالَا أَسْلَمْنَا فَقَتَلْتُهُمَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَمَّا أُقَاتِلُ النَّاسَ إِلَّا عَلَى الْإِسْلَامِ وَاللَّهِ لَا أَسْتَغْفِرُ لَكَ أَوْ كَمَا قَالَ فَمَاتَ بَعْدُ فَدَفَنَتْهُ عَشِيرَتُهُ فَأَصْبَحَ قَدْ نَبَذَتْهُ الْأَرْضُ ثُمَّ دَفَنُوهُ وَحَرَسُوهُ ثَانِيَةً فَنَبَذَتْهُ الْأَرْضُ ثُمَّ قَالُوا لَعَلَّ أَحَدًا جَاءَ وَأَنْتُمْ نِيَامٌ فَأَخْرَجَهُ فَدَفَنُوهُ ثَالِثَةً ثُمَّ حَرَسُوهُ فَنَبَذَتْهُ الْأَرْضُ ثَالِثَةً فَلَمَّا رَأَوْا ذَلِكَ أَلْقَوْهُ أَوْ كَمَا قَالَ

English Translation
ʿArim narrated to us, Muʿtamir ibn Sulaymān narrated to us, from his father, who said: al-Sumayṭ al-Shaybānī narrated to me, from Abū al-ʿAlāʿ, who said: A man from the tribe narrated to me that ʿImrān ibn Ḥuṣayn told him that ʿUbays — or Ibn ʿUbays — along with some people from Banū Jusham came to him. One of them said to him: ‘Will you not fight until there is no more fitnah?’ He said: ‘Perhaps I have already fought until there was no fitnah.’ He said: ‘Shall I not tell you what the Messenger of Allah ﷺ said? Though I do not think it will benefit you, so listen.’ He said: the Messenger of Allah ﷺ said: ‘March, O Banū so-and-so, with so-and-so.’ The men were lined up and the women were behind the men. Then when they returned, a man said: ‘O Prophet of Allah, seek forgiveness for me, may Allah forgive you.’ He said: ‘Have you done something new?’ He said: ‘When the enemy was routed, I found a man between the fighters and the women who said: I am a Muslim — or said: I have submitted — and I killed him.’ He said: ‘Seeking refuge by that when the spear had already reached him?’ He said: ‘Did you split open his heart to look at it?’ He said: ‘No, by Allah, I did not.’ So he did not seek forgiveness for him. And he said in his hadith: the Messenger of Allah ﷺ said: ‘March, O Banū so-and-so, with so-and-so.’ A man from my kin went with them. When he returned to the Prophet ﷺ of Allah ﷺ, he said: ‘O Prophet of Allah, seek Allah’s forgiveness for me, may Allah forgive you.’ He said: ‘Have you done something new?’ He said: ‘When the enemy was routed, I caught up with two men between the fighters and the women, and they said: We are Muslims — or said: We have submitted — and I killed them.’ the Messenger of Allah ﷺ said: ‘What do I fight people for except for Islam? By Allah, I will not seek forgiveness for you’ — or as he said. The man died afterwards, and his clan buried him. But by morning, the earth had expelled him. They buried him again and guarded him a second time, but the earth expelled him again. They said: ‘Perhaps someone came while you were sleeping and removed him.’ So they buried him a third time and guarded him, but the earth expelled him a third time. When they saw that, they left him — or as he said.
