أَخْبَرَنَا عَفَّانُ ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ ، حَدَّثَنَا حَمَّادٌ ، عَنْ إِبْرَاهِيمَ ، عَنْ الْأَسْوَدِ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ : عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّغِيرِ حَتَّى يَحْتَلِمَ، وَعَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ ". وَقَدْ قَالَ حَمَّادٌ أَيْضًا : " وَعَنْ الْمَعْتُوهِ حَتَّى يَعْقِلَ "

It was narrated from Aisha (may Allah be pleased with her) that the Prophet ﷺ said: 'The pen is lifted from three: from the sleeping person until he wakes up, from the young child until he reaches puberty, and from the insane person until he regains his reason.' Hammad also said: 'And from the feeble-minded person until he gains reason.'

أَخْبَرَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ ، عَنْ عُثْمَانَ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا بِإِحْدَى ثَلَاثٍ : بِكُفْرٍ بَعْدَ إِيمَانٍ، أَوْ بِزِنًى بَعْدَ إِحْصَانٍ، أَوْ يَقْتُلُ نَفْسًا بِغَيْرِ نَفْسٍ فَيُقْتَلُ "

It was narrated from Uthman ibn Affan (may Allah be pleased with him) that he heard the Messenger of Allah ﷺ say: 'The blood of a Muslim man is not lawful except in one of three cases: disbelief after faith, adultery after marriage, or killing a person, for which he himself shall be killed.'

حَدَّثَنَا يَعْلَى ، حَدَّثَنَا الْأَعْمَشُ ، عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ ، عَنْ مَسْرُوقٍ ، عَنْ عَبْدِ اللَّهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ، وَأَنِّي رَسُولُ اللَّهِ إِلَّا أَحَدُ ثَلَاثَةِ نَفَرٍ : النَّفْسُ بِالنَّفْسِ، وَالثَّيِّبُ الزَّانِي، وَالتَّارِكُ لِدِينِهِ، الْمُفَارِقُ لِلْجَمَاعَةِ "

It was narrated from Abdullah ibn Masud (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'The blood of a man who testifies that there is no god but Allah and that I am the Messenger of Allah is not lawful except in one of three cases: life for life, the married adulterer, and the one who abandons his religion and separates from the community.'

أَخْبَرَنَا سَعْدُ بْنُ حَفْصٍ ، حَدَّثَنَا شَيْبَانُ ، عَنْ أَشْعَثَ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : كَانَ صَفْوَانُ بْنُ أُمَيَّةَ نَائِمًا فِي الْمَسْجِدِ، فَأَتَاهُ رَجُلٌ وَهُوَ نَائِمٌ، فَاسْتَلَّ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ، فتَنَبَّهَ بِهِ، فَلَحِقَهُ فَأَخَذَهُ فَانْطَلَقَ بِهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ : يَا رَسُولَ اللَّهِ، كُنْتُ نَائِمًا فِي الْمَسْجِدِ، فَأَتَانِي هَذَا فَاسْتَلَّ رِدَائِي مِنْ تَحْتِ رَأْسِي، فَلَحِقْتُهُ فَأَخَذْتُهُ، فَأَمَرَ بِقَطْعِهِ، فَقَالَ لَهُ صَفْوَانُ : يَا رَسُولَ اللَّهِ، إِنَّ رِدَائِي لَمْ يَبْلُغْ أَنْ يُقْطَعَ فِيهِ هَذَا؟ قَالَ :" فَهَلَّا، قَبْلَ أَنْ تَأْتِيَنِي بِهِ؟ "

It was narrated from Ibn Abbas (may Allah be pleased with him) that Safwan ibn Umayyah was sleeping in the mosque when a man came while he was sleeping and took his cloak from under his head. He woke up and caught the man, then brought him to the Messenger of Allah ﷺ. He said: 'O Messenger of Allah, this man stole my cloak.' The Messenger of Allah ﷺ said: 'Cut off his hand.' Safwan said: 'I did not intend that.' The Messenger of Allah ﷺ said: 'Then why did you bring him before me?'

أَخْبَرَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْهَاشِمِيُّ ، أَخْبَرَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ ، عَنْ الزُّهْرِيِّ ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ ، عَنْ عَائِشَةَ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" تُقْطَعُ الْيَدُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا "

It was narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah ﷺ said: 'The hand is cut off for a quarter dinar and above.'

أَخْبَرَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ أَيُّوبَ ، وَإِسْمَاعِيل بْنِ أُمَيَّةَ ، وَعُبَيْدِ اللَّهِ ، وَمُوسَى بْنِ عُقْبَة ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ :" قَطَعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ "

It was narrated from Ibn Umar (may Allah be pleased with him) that the Messenger of Allah ﷺ cut off a hand for a shield (mijan) worth three dirhams.

أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا اللَّيْثُ ، عَنْ ابْنِ شِهَابٍ ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ ، عَنْ عَائِشَةَ : أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ، فَقَالُوا : مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟، قَالُوا : وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ فَكَلَّمَهُ أُسَامَةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ؟ " ثُمَّ قَامَ فَاخْتَطَبَ، فَقَالَ :" إِنَّمَا هَلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهُمُ الشَّرِيفُ، تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ، أَقَامُوا عَلَيْهِ الْحَدَّ، وَايْمُ اللَّهِ، لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ، لَقَطَعْتُ يَدَهَا "

It was narrated from Aisha (may Allah be pleased with her) that the Quraysh were troubled by the affair of the Makhzumi woman who had stolen. They said: 'Who will intercede with the Messenger of Allah ﷺ for her?' They said: 'Who is bold enough to approach him except Usamah ibn Zayd, the beloved of the Messenger of Allah?' So Usamah spoke to him, and the Messenger of Allah ﷺ said: 'O Usamah, are you interceding regarding one of the prescribed punishments of Allah?' Then he stood and delivered a speech saying: 'Verily those before you were destroyed because when a noble person among them stole, they let him go, but when a weak person stole, they applied the punishment to him. By Allah, if Fatimah daughter of Muhammad were to steal, Muhammad would cut off her hand.'

أَخْبَرَنَا حَجَّاجُ بْنُ مِنْهَالٍ ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ إِسْحَاق بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ ، عَنْ أَبِي الْمُنْذِرِ مَوْلَى أَبِي ذَرٍّ، عَنْ أَبِي أُمَيَّةَ الْمَخْزُومِيِّ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُتِيَ بِسَارِقٍ اعْتَرَفَ اعْتِرَافًا، لَمْ يُوجَدْ مَعَهُ مَتَاعٌ، فَقَالَ :" مَا إِخَالُكَ سَرَقْتَ؟ " قَالَ : بَلَى، قَالَ : " مَا إِخَالُكَ سَرَقْتَ؟ " قَالَ : بَلَى، قَالَ : " فَاذْهَبُوا فَاقْطَعُوا يَدَهُ ثُمَّ جِيئُوا بِهِ " فَقَطَعُوا يَدَهُ، ثُمَّ جَاءُوا بِهِ، فَقَالَ : " اسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ "، فَقَالَ : أَسْتَغْفِرُ اللَّهَ وَأَتُوبُ إِلَيْهِ، فَقَالَ : " اللَّهُمَّ تُبْ عَلَيْهِ، اللَّهُمَّ تُبْ عَلَيْهِ "

It was narrated from Abu Umayyah al-Makhzumi (may Allah be pleased with him) that a thief was brought to the Messenger of Allah ﷺ who had confessed but with whom no stolen goods were found. The Messenger of Allah ﷺ said: 'I do not think you stole.' He said: 'Yes, I did.' He repeated it three times, and the Messenger of Allah ﷺ gave the order and his hand was cut off.

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا يَحْيَى هُوَ ابْنُ سَعِيدٍ ، أَنَّ مُحَمَّدَ بْنَ يَحْيَى بْنِ حَبَّانَ أَخْبَرَهُ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ "

It was narrated from Rafi ibn Khadij (may Allah be pleased with him) that he heard the Messenger of Allah ﷺ say: 'There is no amputation for fruit or palm dates (kathar).'

حَدَّثَنَا الْحُسَيْنُ بْنُ مَنْصُورٍ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ ، عَنْ رَجُلٍ مِنْ قَوْمِهِ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ "

It was narrated from Rafi ibn Khadij (may Allah be pleased with him) that the Prophet ﷺ said: 'There is no amputation for fruit or palm dates.'

أَخْبَرَنَا إِسْحَاق ، حَدَّثَنَا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ ، عَنْ عَمِّهِ وَاسِعِ بْنِ حَبَّانَ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ ". حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ

It was narrated from Rafi ibn Khadij (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'There is no amputation for fruit or palm dates.'

أَخْبَرَنَا إِسْحَاق ، حَدَّثَنَا جَرِيرٌ ، وَالثَّقَفِيُّ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَخْبَرَنِي مُحَمَّدُ بْنُ يَحْيَى بْنِ حَبَّانَ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ ". قَالَ : وَهُوَ شَحْمُ النَّخْلِ. وَالْكَثَرُ : الْجُمَّارُ

It was narrated from Rafi ibn Khadij (may Allah be pleased with him) that he heard the Prophet ﷺ say: 'There is no amputation for fruit or palm dates.'

أَخْبَرَنَا سَعِيدُ بْنُ مَنْصُورٍ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ ، عَنْ أَبِي مَيْمُونٍ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" لَا قَطْعَ فِي كَثَرٍ ". قَالَ أَبُو مُحَمَّد : الْقَوْلُ مَا قَالَ أَبُو أُسَامَةَ

It was narrated from Rafi ibn Khadij (may Allah be pleased with him) that he heard the Prophet ﷺ say: 'There is no amputation for fruit or palm dates.'

أَخْبَرَنَا أَبُو عَاصِمٍ ، عَنْ ابْنِ جُرَيْجٍ ، قَالَ : أَنْبَأَنَا أَبُو الزُّبَيْرِ ، قَالَ جَابِرٌ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَيْسَ عَلَى الْمُنْتَهِبِ، وَلَا عَلَى الْمُخْتَلِسِ، وَلَا عَلَى الْخَائِنِ قَطْعٌ "

It was narrated from Jabir ibn Abdullah (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'There is no amputation for a plunderer (munatahib), nor a snatcher (mukhtalis), nor a traitor (kha'in).'

حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ ، حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنْ أَنَسٍ ، " أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَأُتِيَ بِرَجُلٍ قَدْ شَرِبَ خَمْرًا فَضَرَبَهُ بِجَرِيدَتَيْنِ "، ثُمَّ فَعَلَ أَبُو بَكْرٍ مِثْلَ ذَلِكَ، فَلَمَّا كَانَ عُمَرُ : اسْتَشَارَ النَّاسَ، فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ : أَخَفُّ الْحُدُودِ : ثَمَانِينَ، قَالَ : فَفَعَلَ

It was narrated from Anas ibn Malik (may Allah be pleased with him) that a man who had drunk wine was brought to the Prophet ﷺ and he struck him with two palm branches. Then Abu Bakr did the same. When Umar became caliph, he consulted the people and Abd al-Rahman ibn Awf said: 'The lightest of the hadd punishments is eighty lashes.' So Umar ordered it to be eighty.

حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ ، أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ الْمُخْتَارِ ، حَدَّثَنَا عَبْدُ اللَّهِ الدَّانَاجُ ، حَدَّثَنَا حُضَيْنُ بْنُ الْمُنْذِرِ الرَّقَاشِيُّ ، قَالَ : شَهِدْتُ عُثْمَانَ بْنَ عَفَّانَ وَأُتِيَ بِالْوَلِيدِ بْنِ عُقْبَةَ، فَقَالَ عَلِيٌّ :" جَلَدَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْبَعِينَ، وَجَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ، وَعُمَرُ ثَمَانِينَ، وَكُلٌّ سُنَّةٌ "

It was narrated that Ali ibn Abi Talib (may Allah be pleased with him) was present when Uthman ibn Affan brought al-Walid ibn Uqbah who had drunk wine. Ali said: 'The Prophet ﷺ gave forty lashes, Abu Bakr gave forty lashes, and Umar gave eighty lashes; all of them are Sunnah, but this one (eighty) is more dear to me.'

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ ، حَدَّثَنَا يَزِيدُ هُوَ ابْنُ زُرَيْعٍ ، حَدَّثَنَا مُحَمَّدٌ هُوَ ابْنُ إِسْحَاق ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عُتْبَةَ بْنِ عُرْوَةَ بْنِ مَسْعُودٍ الثَّقَفِيُّ ، عَنْ عَمْرِو بْنِ الشَّرِيدِ ، عَنْ أَبِيهِ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" إِذَا شَرِبَ أَحَدُكُمْ فَاضْرِبُوهُ، ثُمَّ إِنْ عَادَ، فَاضْرِبُوهُ، ثُمَّ إِنْ عَادَ، فَاضْرِبُوهُ، ثُمَّ إِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ "

It was narrated from al-Sharid ibn Suwayd al-Thaqafi (may Allah be pleased with him) that he heard the Messenger of Allah ﷺ say: 'There should be no self-inflicted harm and no harm done by others, and a lewd person (mukhannath) should not be lashed.'

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ ، حَدَّثَنَا سَعِيدٌ هُوَ ابْنُ أَبِي أَيُّوبَ ، حَدَّثَنِي يَزِيدُ بْنُ أَبِي حَبِيبٍ ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الْأَشَجِّ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ عَبْدِ الرَّحْمَنِ هُوَ ابْنُ جَابِرٍ ، عَنْ أَبِي بُرْدَةَ بْنِ نِيَارٍ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" لَا يَحِلُّ لِأَحَدٍ أَنْ يَضْرِبَ أَحَدًا فَوْقَ عَشْرَةِ أَصْوَاتٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ "

It was narrated from Abu Burdah ibn Niyar (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'No one should be flogged more than ten lashes except for one of the prescribed punishments of Allah.'

أَخْبَرَنَا أَبُو عَاصِمٍ ، حَدَّثَنَا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي ابْنُ شِهَابٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرٍ : أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَحَدَّثَهُ أَنَّهُ زَنَى فَشَهِدَ عَلَى نَفْسِهِ أَنَّهُ زَنَى أَرْبَعًا،فَأَمَرَ بِرَجْمِهِ وَكَانَ قَدْ أُحْصِنَ "

It was narrated from Jabir ibn Abdullah (may Allah be pleased with him) that a man from the Aslam tribe came to the Prophet ﷺ and told him that he had committed adultery and testified against himself four times. The Messenger of Allah ﷺ then ordered him to be stoned and he was stoned.

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، عَنْ إِسْرَائِيلَ ، عَنْ سِمَاكٍ ، أَنَّهُ سَمِعَ جَابِرَ بْنَ سَمُرَةَ يَقُولُ : أُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ قَصِيرٍ فِي إِزَارٍ مَا عَلَيْهِ رِدَاءٌ، وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُتَّكِئٌ عَلَى وِسَادَةٍ عَلَى يَسَارِهِ فَكَلَّمَهُ، فَمَا أَدْرِي مَا يُكَلِّمُهُ بِهِ، وَأَنَا بَعِيدٌ مِنْهُ، بَيْنِي وَبَيْنَهُ الْقَوْمُ، ثُمَّ قَالَ :" اذْهَبُوا بِهِ فَارْجُمُوهُ "، ثُمَّ قَالَ : " رُدُّوهُ "، فَكَلَّمَهُ أَيْضًا وَأَنَا أَسْمَعُ غَيْرَ أَنَّ بَيْنِي وَبَيْنَهُ الْقَوْمُ، فَقَالَ : " اذْهَبُوا بِهِ فَارْجُمُوهُ "، ثُمَّ قَامَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَخَطَبَ وَأَنَا أَسْمَعُهُ، ثُمَّ قَالَ : " كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللَّهِ، خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ مِنَ اللَّبَنِ؟ وَاللَّهِ لَا أَقْدِرُ عَلَى أَحَدٍ مِنْهُمْ، إِلَّا نَكَّلْتُ بِهِ "

It was narrated from Jabir ibn Samurah (may Allah be pleased with him) that he said: 'Ma'iz ibn Malik, a short man wearing a lower garment and no upper garment, was brought to the Prophet ﷺ. The Messenger of Allah ﷺ said to him: "Perhaps you only kissed, or touched, or looked?" He said: "No, O Messenger of Allah." He asked: "Did you do with her what a man does with his wife?" He said: "Yes." He said: "You mean just as a peg enters a kohl container?" He said: "Yes." He ordered him to be stoned and he was stoned.'

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، عَنْ أَبِي هُرَيْرَةَ ، وَزَيْدِ بْنِ خَالِدٍ ، وَشِبْلٍ ، قَالُوا : جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ : أَنْشُدُكَ اللَّهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ، فَقَالَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ : صَدَقَ، اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَأْذَنْ لِي يَا رَسُولَ اللَّهِ أَنْ أَتَكَلَّمَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " قُلْ "، فَقَالَ : إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى أَهْلِ هَذَا، فَزَنَى بِامْرَأَتِهِ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ، وَإِنِّي سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ، وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ، فَقَالَ : " وَالَّذِي نَفْسِي بِيَدِهِ،لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ : الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَيَا أُنَيْسُ اغْدُ عَلَى امْرَأَةِ هَذَا فَسَلْهَا، فَإِنْ اعْتَرَفَتْ، فَارْجُمْهَا "، فَاعْتَرَفَتْ، فَرَجَمَهَا

It was narrated from Abu Hurairah, Zayd ibn Khalid, and Shibl (may Allah be pleased with them) that they said: 'A man came to the Messenger of Allah ﷺ while we were present and said: "O Messenger of Allah, if my slave girl commits adultery and I find no husband for her, shall I apply the hadd to her?" The Messenger of Allah ﷺ said: "If she commits adultery, flog her. If she commits adultery again, flog her. If she commits adultery a third time, sell her, even for a rope of hair."'

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، حَدَّثَنَا مُحَمَّدٌ هُوَ ابْنُ إِسْحَاق بْنِ يَسَارٍ ، حَدَّثَنَا مُحَمَّدُ بْنُ إِبْرَاهِيمَ التَّيْمِيُّ ، عَنْ أَبِي الْهَيْثَمِ بْنِ نَصْرِ بْنِ دَهْرٍ الْأَسْلَمِيِّ ، عَنْ أَبِيهِ ، قَالَ : كُنْتُ فِيمَنْ رَجَمَهُ، قَالَ أَبُو مُحَمَّدٍ : يَعْنِي مَاعِزَ بْنَ مَالِكٍ، فلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ، جَزِعَ جَزَعًا شَدِيدًا، قَالَ : فَذَكَرْنَا ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" فَهَلَّا تَرَكْتُمُوهُ؟ "

It was narrated from Nahr ibn Dahr al-Aslami (may Allah be pleased with him) that he said: 'We were with the Messenger of Allah ﷺ when a man came and confessed to adultery. The Messenger of Allah ﷺ turned away from him. He confessed again on the second side, and he turned away from him. He confessed again on the third side, and he turned away from him. When he confessed a fourth time, the Prophet ﷺ ordered him to be stoned and he was stoned.'

أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى ، حَدَّثَنَا يَحْيَى بْنُ أَبِي زَائِدَةَ ، عَنْ دَاوُدَ ، عَنْ أَبِي نَضْرَةَ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" انْطَلِقُوا بِمَاعِزِ بْنِ مَالِكٍ، فَارْجُمُوهُ ". فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ ، فَوَاللَّهِ مَا أَوْثَقْنَاهُ وَلَا حَفَرْنَا لَهُ، وَلَكِنْ قَامَ فَرَمَيْنَاهُ بِالْعِظَامِ وَالْخَزَفِ وَالْجَنْدَلِ

It was narrated from Abu Said al-Khudri (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'Take Ma'iz ibn Malik and stone him.' We took him to the Baqi cemetery and stoned him. When the stones struck him he fled, but we overtook him at al-Harra and stoned him until he died.

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا بَشِيرُ بْنُ الْمُهَاجِرِ ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ ، عَنْ أَبِيهِ ، قَالَ : كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَاءَهُ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ، فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا، فَرَدَّهُ ثَلَاثَ مَرَّاتٍ، ثُمَّ جَاءَ الرَّابِعَةَ فَاعْتَرَفَ،" فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ، وَأَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ "

It was narrated from Buraydah al-Aslami (may Allah be pleased with him) that he said: 'I was sitting with the Prophet ﷺ when a woman from the Ghamid tribe came to him and said: "O Prophet of Allah, I have committed adultery." He turned away from her. She confessed a second time, a third time, and a fourth time. When she had confessed four times he told her to leave until she had given birth. After giving birth she was brought to him and he gave orders for her to be stoned. She was stoned.'

أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا زُهَيْرٌ ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ : أَنَّ الْيَهُودَ جَاءُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ قَدْ زَنَيَا، فَقَالَ :" كَيْفَ تَفْعَلُونَ بِمَنْ زَنَى مِنْكُمْ؟ ". قَالُوا : لَا نَجِدُ فِيهَا شَيْئًا، فَقَالَ لَهُمْ عَبْدُ اللَّهِ بْنُ سَلَامٍ : كَذَبْتُمْ، فِي التَّوْرَاةِ الرَّجْمُ، فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ، فَوَضَعَ مِدْرَاسُهَا الَّذِي يَدْرُسُهَا مِنْهُمْ كَفَّهُ عَلَى آيَةِ الرَّجْمِ، فَقَالَ : مَا هَذِهِ؟ فَلَمَّا رَأَوْا ذَلِكَ قَالُوا : هِيَ آيَةُ الرَّجْمِ، " فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " فَرُجِمَا قَرِيبًا مِنْ حَيْثُ تُوضَعُ الْجَنَائِزُ عِنْدَ الْمَسْجِدِ. قَالَ عَبْدُ اللَّهِ : فَرَأَيْتُ صَاحِبَهَا يُخْبِئُ عَلَيْهَا : يَقِيهَا الْحِجَارَةَ

It was narrated from Ibn Umar (may Allah be pleased with him) that the Jews came to the Messenger of Allah ﷺ with a man and a woman among them who had committed adultery. He asked: 'What do you do with someone who commits adultery among you?' They said: 'We blacken their faces and beat them.' He said: 'Do you not find the stoning (rajm) in the Torah?' They said: 'We find nothing in it.' Abdullah ibn Salam said: 'You lie. Bring the Torah and recite it if you are truthful.' They brought it and placed it, and one of them covered the verse about stoning with his hand, and read what was before and after it. Ibn Salam said: 'Lift your hand.' He lifted it and the verse of stoning appeared. He said: 'He spoke the truth, O Messenger of Allah, the verse of stoning is in it.' The Messenger of Allah ﷺ ordered them to be stoned and they were stoned.

أَخْبَرَنَا خَالِدُ بْنُ مَخْلَدٍ ، حَدَّثَنَا مَالِكٌ ، عَنْ الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ عُمَرُ :" إِنَّ اللَّهَ تَعَالَى، بَعَثَ مُحَمَّدًا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْحَقِّ، وَأَنْزَلَ عَلَيْهِ الْكِتَابَ، وَكَانَ فِيمَا أَنْزَلَ آيَةُ الرَّجْمِ، فَقَرَأْنَاهَا وَوَعَيْنَاهَا وَعَقَلْنَاهَا، وَرَجَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَرَجَمْنَا بَعْدَهُ، فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ الْقَائِلُ : لَا نَجِدُ حَدَّ آيَةِ الرَّجْمِ فِي كِتَابِ اللَّهِ، وَالرَّجْمُ فِي كِتَابِ اللَّهِ حَقٌّ عَلَى مَنْ زَنَى مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا أُحْصِنَّ، إِذَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ، أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ "

Umar ibn al-Khattab (may Allah be pleased with him) said: 'Verily Allah sent Muhammad ﷺ with the truth and revealed to him the Book. Among what was revealed to him was the verse of stoning (ayat al-rajm). We recited it and understood it. The Messenger of Allah ﷺ applied stoning and we applied it after him. I fear that as time passes, someone will say: "We do not find stoning in the Book of Allah," and so they will go astray by abandoning an obligation that Allah has revealed. Verily stoning is the truth for the married fornicator, man or woman, when there is evidence or pregnancy or confession.'

أَخْبَرَنَا مُحَمَّدُ بْنُ يَزِيدَ الرِّفَاعِيُّ ، حَدَّثَنَا الْعَقَدِيُّ ، حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنْ يُونُسَ بْنِ جُبَيْرٍ يُحَدِّثُ : عَنْ كَثِيرِ بْنِ الصَّلْتِ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، قَالَ : أَشْهَدُ لَسَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا، فَارْجُمُوهُمَا الْبَتَّةَ "

It was narrated from Zayd ibn Thabit (may Allah be pleased with him) that he said: 'I bear witness that I heard the Messenger of Allah ﷺ say: "Stoning (rajm) is true, and it is in the Book of Allah."'

أَخْبَرَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا بَشِيرُ بْنُ الْمُهَاجِرِ ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ ، عَنْ أَبِيهِ ، قَالَ : كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَاءَتْهُ امْرَأَةٌ مِنْ بَنِي غَامِدٍ، فَقَالَتْ : يَا نَبِيَّ اللَّهِ إِنِّي قَدْ زَنَيْتُ، وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي، فَقَالَ لَهَا : " ارْجِعِي ". فَلَمَّا كَانَ مِنْ الْغَدِ، أَتَتْهُ أَيْضًا، فَاعْتَرَفَتْ عِنْدَهُ بِالزِّنَاء، فَقَالَتْ : يَا نَبِيَّ اللَّهِ، طَهِّرْنِي، فَلَعَلَّكَ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ، فَوَاللَّهِ إِنِّي لَحُبْلَى، فَقَالَ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " ارْجِعِي، حَتَّى تَلِدِي ". فَلَمَّا وَلَدَتْ، جَاءَتْ بِالصَّبِيِّ تَحْمِلُهُ فِي خِرْقَةٍ، فَقَالَتْ : يَا نَبِيَّ اللَّهِ هَذَا قَدْ وَلَدْتُ، قَالَ : " فَاذْهَبِي فَأَرْضِعِيهِ، ثُمَّ افْطُمِيهِ ". فَلَمَّا فَطَمَتْهُ، جَاءَتْهُ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ، فَقَالَتْ : يَا نَبِيَّ اللَّهِ، قَدْ فَطَمْتُهُ، فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالصَّبِيِّ فَدُفِعَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ، وَأَمَرَ بِهَا فَحُفِرَ لَهَا حُفْرَةٌ، فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا، ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهَا، فَأَقْبَلَ خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَرَمَى رَأْسَهَا، فَتَلَطَّخَ الدَّمُ عَلَى وَجْنَةِ خَالِدِ بْنِ الْوَلِيدِ، فَسَبَّهَا، فَسَمِعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَبَّهُ إِيَّاهَا، فَقَالَ : " مَهْ يَا خَالِدُ،لَا تَسُبَّهَا، فَوَالَّذِي نَفْسِي بِيَدِهِ، لَقَدْ تَابَتْ تَوْبَةً، لَوْ تَابَهَا صَاحِبُ مَكْسٍ، لَغُفِرَ لَهُ ". فَأَمَرَ بِهَا فَصُلِّيَ عَلَيْهَا، وَدُفِنَتْ

It was narrated from Buraydah al-Aslami (may Allah be pleased with him) that he said: 'I was sitting with the Prophet ﷺ when a woman from Ghamid came and said: "O Prophet of Allah, purify me." He said: "Woe to you. Go back and seek forgiveness and repent to Allah." She said: "I think you want to turn me away as you turned away Ma'iz ibn Malik." He said: "What is the matter with you?" She said: "I am pregnant from adultery." He said: "Is it you?" She said: "Yes." He said: "Not until you give birth." A man from the Ansar took responsibility for her until she gave birth. He came to the Prophet ﷺ and said: "The Ghamidiyyah has given birth." He said: "Then we will not stone her and leave her child without a nursemaid." A man from the Ansar took over the nursing for her. Then he came to him and he ordered her stoning, and she was stoned.'

حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ ، حَدَّثَنَا هِشَامٌ ، عَنْ يَحْيَى ، عَنْ أَبِي قِلَابَةَ ، عَنْ أَبِي الْمُهَلَّبِ ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ : أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ أَتَت ِالنَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهِيَ حُبْلَى مِنَ الزِّنَاءِ، فَقَالَتْ : يَا رَسُولَ اللَّهِ، إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ، فَدَعَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلِيَّهَا، فَقَالَ : " اذْهَبْ فَأَحْسِنْ إِلَيْهَا، فَإِذَا وَضَعَتْ حَمْلَهَا، فَأْتِنِي بِهَا ". فَفَعَلَ، فَأَمَرَ بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَشُكَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا، فَقَالَ عُمَرُ : يَا رَسُولَ اللَّهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟، فَقَالَ :" لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ، وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ G "

It was narrated from Imran ibn Husayn (may Allah be pleased with him) that a woman from Juhaynah came to the Prophet ﷺ while she was pregnant from adultery and said: 'O Messenger of Allah, I have committed a prescribed offence, so apply it to me.' The Prophet ﷺ called her guardian and said: 'Be good to her, and when she gives birth bring her to me.' When she gave birth he brought her, and the Prophet ﷺ commanded her clothes to be tied tightly around her. Then he ordered her to be stoned and she was stoned. He then prayed over her. Umar said to him: 'O Prophet of Allah, you pray over her when she has committed adultery?' He said: 'She has repented a repentance that if it were divided among seventy people of Madinah it would be sufficient for them. Have you found anyone who gives something more excellent than sacrificing her own soul for Allah?'

حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ ، حَدَّثَنَا مَالِكٌ ، عَنْ ابْنِ شِهَابٍ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَأَبِي هُرَيْرَةَ : أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ، فَقَالَ :" إِنْ زَنَتْ، فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ". قَالَ : فَمَا أَدْرِي فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ " فَبِيعُوهَا وَلَوْ بِضَفِيرٍ "

It was narrated from Zayd ibn Khalid al-Juhani and Abu Hurairah (may Allah be pleased with them) that the Prophet ﷺ was asked about a slave girl who commits adultery without being married. He said: 'If she commits adultery, flog her; if she commits adultery again, flog her; if she commits adultery a third time, sell her, even for a hair rope.'

أَخْبَرَنَا بِشْرُ بْنُ عُمَرَ الزَّهْرَانِيُّ ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ قَتَادَةَ ، عَنْ الْحَسَنِ ، عَنْ حِطَّانَ بْنِ عَبْدِ اللَّهِ ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" خُذُوا عَنِّي خُذُوا عَنِّي. قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلًا : الْبِكْرُ بِالْبِكْرِ، وَالثَّيِّبُ بِالثَّيِّبِ : الْبِكْرُ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ، وَالثَّيِّبُ جَلْدُ مِائَةٍ وَالرَّجْمُ "، أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ ، أَخْبَرَنَا هُشَيْمٌ ، عَنْ مَنْصُورٍ ، عَنْ الْحَسَنِ ، عَنْ حِطَّانَ بْنِ عَبْدِ اللَّهِ ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِنَحْوِهِ

It was narrated from Ubadah ibn al-Samit (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'Take from me, take from me. Allah has appointed a way for them: for the unmarried with the unmarried it is one hundred lashes and exile for one year; and for the married with the married it is one hundred lashes and stoning.'

أَخْبَرَنَا يَحْيَى بْنُ حَمَّادٍ ، حَدَّثَنَا أَبَانُ بْنُ يَزِيدَ ، عَنْ قَتَادَةَ ، قَالَ : كَتَبَ إِلَيَّ خَالِدُ بْنُ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ : أَنَّ غُلَامًا كَانَ يُنْبَزُ قُرْقُورًا، فَوَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ، فَرُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ ، فَقَالَ : لَأَقْضِيَنَّ فِيهِ بِقَضَاءٍ شَافٍ :" إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً، وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَهُ، رَجَمْتُهُ "، فَقِيلَ لَهَا : زَوْجُكِ !، فَقَالَتْ : إِنِّي قَدْ أَحْلَلْتُهَا لَهُ. فَضَرَبَهُ مِائَةً. قَالَ يَحْيَى : هُوَ مَرْفُوعٌ. حَدَّثَنَا صَدَقَةُ بْنُ الْفَضْلِ ، أَخْبَرَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، عَنْ شُعْبَةَ ، عَنْ أَبِي بِشْرٍ ، عَنْ خَالِدِ بْنِ عُرْفُطَةَ ، عَنْ حَبِيبِ بْنِ سَالِمٍ ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ

It was narrated from Habib ibn Salim that a young man who was called Qurqurah committed an act with his wife's slave girl and the matter was brought before al-Nu'man ibn Bashir. He wrote to ask the Messenger of Allah ﷺ about it. He ﷺ replied: 'If the wife permitted him to have her slave girl, flog him one hundred lashes; if she did not permit him, stone him to death.'

أَخْبَرَنَا مَرْوَانُ بْنُ مُحَمَّدٍ الدِّمَشْقِيُّ ، حَدَّثَنَا ابْنُ وَهْبٍ ، عَنْ أُسَامَةَ بْنِ زَيْدٍ ، عَنْ مُحَمَّدِ بْنِ الْمُنَكْدِرِ ، عَنْ ابْنِ خُزَيْمَةَ بْنِ ثَابِتٍ ، عَنْ أَبِيهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" مَنْ أُقِيمَ عَلَيْهِ حَدٌّ، غُفِرَ لَهُ ذَلِكَ الذَّنْبُ "

It was narrated from Khuzaymah ibn Thabit (may Allah be pleased with him) that the Messenger of Allah ﷺ said: 'Whoever has a prescribed punishment (hadd) applied to him, that is his expiation.'
