أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أنبأنا هَمَّ

امٌ ، عَنْ قَتَادَةَ ، قَال : # إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ بِالْمَعْرُوفِ حَقًّا عَلَى الْمُتَّقِينَ سورة البقرة آية 180 #،فَأَمَرَ أَنْ يُوصِيَ لِوَالِدَيْهِ وَأَقَارِبِهِ، ثُمَّ نُسِخَ بَعْدَ ذَلِكَ فِي سُورَةِ النِّسَاءِ ، فَجَعَلَ لِلْوَالِدَيْنِ نَصِيبًا مَعْلُومًا، وَأَلْحَقَ لِكُلِّ ذِي مِيرَاثٍ نَصِيبَهُ مِنْهُ، وَلَيْسَتْ لَهُمْ وَصِيَّةٌ، فَصَارَتْ الْوَصِيَّةُ لِمَنْ لَا يَرِثُ مِنْ قَرِيبٍ وَغَيْرِهِ "

English Translation

It was narrated from Qatada regarding the verse: {when death approaches one of you and he leaves some good, to make a bequest for parents and near relatives} (Quran 2:180) — that the command was to bequeath to one's parents and relatives. Then this was abrogated afterward in Surah al-Nisa', which assigned parents a known fixed share and gave every heir their portion. So there is no bequest for heirs — bequests became only for non-inheriting relatives and others.
