English Translation

It was narrated — via Muhammad ibn Ja'far, from Shu'ba, from Abu Qays, from Huzayl ibn Shurabhil — that he said: 'A man asked Abu Musa al-Ash'ari about a woman who died leaving a daughter, a son's daughter, and a sister. He said: "The daughter gets a half, and the sister gets a half." And [Abu Musa] said: "Go to Ibn Mas'ud — he will agree with me." They went to Ibn Mas'ud and informed him of Abu Musa's ruling. He said: "I would have gone astray and would not be among the guided if I were to rule otherwise than what the Messenger of Allah ﷺ ruled." Shu'ba said: "I found this wording written down: 'I will rule in this according to the ruling of the Messenger of Allah ﷺ: the daughter gets a half, the son's daughter gets a sixth [to complete the two-thirds], and the remainder goes to the sister.'" They went back to Abu Musa and told him of Ibn Mas'ud's ruling. Abu Musa said: "Do not ask me about anything for as long as this great scholar [al-habr] is among you."'
