‏ ‏حَدَّثَنَا ‏ ‏يَزِيدُ ‏ ‏أَخْبَرَنَا ‏ ‏مُحَمَّدُ بْنُ رَاشِدٍ ‏ ‏عَنْ ‏ ‏سُلَيْمَانَ بْنِ مُوسَى ‏ ‏عَنْ ‏ ‏عَمْرِو بْنِ شُعَيْبٍ ‏ ‏عَنْ ‏ ‏أَبِيهِ ‏ ‏عَنْ ‏ ‏جَدِّهِ ‏ ‏أَنَّ النَّبِيَّ ‏ ‏صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ‏ ‏قَضَى ‏ ‏أَيُّمَا ‏ ‏مُسْتَلْحَقٍ ‏ ‏اسْتُلْحِقَ ‏ ‏بَعْدَ أَبِيهِ الَّذِي يُدْعَى لَهُ ادَّعَاهُ وَرَثَتُهُ قَضَى إِنْ كَانَ مِنْ حُرَّةٍ تَزَوَّجَهَا أَوْ مِنْ أَمَةٍ يَمْلِكُهَا فَقَدْ لَحِقَ بِمَا ‏ ‏اسْتَلْحَقَهُ ‏ ‏وَإِنْ كَانَ مِنْ حُرَّةٍ أَوْ أَمَةٍ ‏ ‏عَاهَرَ ‏ ‏بِهَا لَمْ يَلْحَقْ بِمَا ‏ ‏اسْتَلْحَقَهُ ‏ ‏وَإِنْ كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ هُوَ ادَّعَاهُ وَهُوَ ابْنُ زِنْيَةٍ لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً ‏

English Translation

It was narrated from 'Abdullah ibn 'Amr (رضي الله عنهما) — via Yazid, from Muhammad ibn Rashid, from Sulayman ibn Musa, from 'Amr ibn Shu'ayb, from his father, from his grandfather — that the Prophet ﷺ ruled: 'Any person whose lineage is claimed after his father — the man whose name he bore — has died, and the heirs make the claim: if the child was born from a free woman [the deceased] had married, or from a slave woman he owned, then the lineage is established as claimed. But if it was from a free woman or a slave woman through fornication, then the lineage is not established as claimed. And if the father himself — the one whose name the child bears — had claimed him, and the child is of illegitimate birth, then [the child] belongs to the mother's family — whether they are free or slaves.'
